The advice that has been given has nothing to do with hating bailiffs and everything to do with helping someone who may be in a vulnerable position pay WHAT THEY OWE not what they are told they owe which is a very different and in many cases incorrect thing.The money is owed to the council not the bailiff so the individual is paying the money owed to the institution the money is owed too. The practice of using bailiffs in the current climate is very much like using a sledgehammer to crack a nut.

Oh I have done Brassnecked, its why in all the correspondence where I have mentioned them to the council/equita/moj/lgo/oft I have stated date and TIME they were sent as well.All I wanted originally was for it to be taken back by BCC, now I want to ensure they dont do this to more vulnerable people than myself. If they can argue the toss as much as they have with me when all the way through I have shown I can PROVE they werent at my house what are they doing to other people?It makes me very very angry

That's fantastic! I would also send copies of your evidence to the ministry for justice as it shows clearly that fictitious fees are added to accounts of individuals who may be vulnerable.

Everyone who has problems with a bailiff should complain to the OFT local councillor mp and ministry for justice the more of us that do the more it shows the depth of the problem

This is the same fob off I have received follow Brassnecked advice above and pay the council the amount you have stated you can pay directly.

I have included Equita in all communication to the council that way when you complain to the OFT & LGO you have given them the opportunity to address your concerns. I would still complain to the OFT etc though.

Thanks both, will put that in the email. I called from work and home unfortunately, the mobile was used for the text convo with the bailiff. BCC states that all calls are recorded so they should have copies I'm less interested in those though because I make notes it's the info they hold on my account written by them and Equita I want.

So I am going to email suggesting that they check for calls made at the same time as the notes on my account and to remind them that the info needs to be with me this week do I need to do anything else?

Well that's my next plan of action do we will see. I agree they're unlikely too but as there is much evidence to support the claim that crapita are committing wholesale fraud.

Those of you following this may recall at the end of July I requested all info held on me by BCC today I received a letter asking for telephone nos cos they can't trace any calls oh how I laughed they have called me on both of the numbers I have used...

The reason for contacting yourselves is that the relationship between councils/Capita/Equita and Ross & Robers results in a clear conflict of interest and is detrimental to the public interest and procedural fairness in enforcement. Capita have a reason not to deal with debtors according to the regulations, but as the appointed bailiffs are part of their group of companies, they are more inclined to use legal enforcement as a first rather than last resort to aid the profitability of their bailiff arms. There are many individuals who have been subject to illegal workings by the bailiff company (front loading of fees, harassment of vulnerable individuals etc) this is then not robustly investigated by the council concerned as it is not in their interest to do so. On the 9th of July the bailiff informed me via text he was too busy to talk to me and I offered the payment plan of £35 per month your guidelines state that the bailiff should have contacted you with my offer you are telling me instead he chose to levy on a random vehicle without knocking on my door or handing the paperwork to myself or my husband is this correct bearing in mind it is contrary to the guidelines and the law regarding levies? This amount is outstanding through an error made by Birmingham City Council, because I believe in the need for Council Tax I am paying it your behaviour and the behaviour of your appointed representatives are causing me great distress this is particularly important in light of my medical history and the fact that the form of migraine I suffer from puts me at increase risk of stroke. I have already requested that this by put through to the final stage complaints process as I WILL be passing this information onto the LGO and if this continues will seek legal advice.
