  1. hello , im asking for some advice on behalf of my friend who has just received a red removal notice post through her letterbox it is a demand for immediate payment of £700+ for council tax dating back to october 2008 . this debt she is almost certain she has paid already over 18mths ago but is unable to find the receipt . also is this debt now enforceable being as it is over 6yrs old ? . the company involved is jacobs , any help or advice in this matter would be appreciated.
  2. no my wife had used the car without my knowledge or consent thats the whole point so , as far as im concerned this whole thing has nothing to do with me other than the fact that iam the registered keeper the only person named on my insurance is me . as i explained earlier my wife has already been dealt with by the local court for using the car without insurance and leaving the scene of an accident without leaving her details .
  3. the true account was the statement given by my wife to the police officer and this was also accepted by the magistrates court . the police had already informed my insurers ( this i think was prior to them interveiwing my wife and taking her statement , and finding out if she was covered on my insurance to drive the car ) . i didn`t inform my insurer of my wife court case as i didnt think it was of any interest to them . the evidence given in my wifes court case was that given to the police . the details on the poc are purely fictious there are no true facts in it at all apart from the registration of my vw polo .

  5. the date on the top right hand of the form is 20/06/2014 . the particulars of the claim are ; on the 4th day of decemeber 2013 the claimants fiat ulysees motor vehicle registration number --02--- was parked and unattended in ------- st farnworth when at approximately 14.20 the 1st defendants ( my name ) was driving a volkswagon polo motor vehicle registration number --51--- when he lost control of his vehicle and collided with the claiments parked and unattended vehicle causing the claimant to suffer loss and damage . 2. the 2nd defendant was the insurer of ( my name ) and --51--- for the purposes of sections 143 and 145 , or alternatively section 151 (2) (b) of the road traffic act 1968 and by virtue of regulation 3 of the european communities ( rights against insurers ) regulations 2002 the 2nd defendants are obliged to indemnify the 1st defendant and satisfy the judgement directly to the claimant . 3. the claimant says the 1st defendant was negligent because of the following matters :- particulars of negligence (1) he failed to keep any or any proper look out ; (2) he failed to heed the presence of the claimants vehicle in good time or at all ; (3) he drove into collision with the claimants vehicle when by exercising proper care and skill he could avoid doing so ; (4) he failed to brake , steer or control his vehicle so as to avoid an accident ; (5) by reason of the above matters the claimant suffered loss and damage . particulars of loss and damage (i) repairs £350.00 (6) further the claimant claims interest pursuant to section 69 of the county courts act 1984 on special damages at such rate and for such period the court sees fit and the claimant claims ;- 1. damages limited to £350.00 2. interest as detailed in paragraph 6 ; 3. costs . the above are what i recieved from northampton county court , as i said earlier though i was not the driver , my wife was and she has already been dealt with by the local magistrates courts . the owner of the fiat car must have been given my wifes details because a traffic cop came to our home and took a full statement of my wife .
  6. i hope someone can advise my best course of action to take here . briefly my wife used a car which is owned by me but she isn`t covered for insurance wise whilst out in the car she had to manoevere out of a parking space when she clipped another vehicle , foolishly she then drove away without leaving details . the next morning a traffic cop arrived at our home took a statement from my wife in which she readily admitted her guilt and she subsequently had to attend the local magistrates court and was fined and her licence endorsed . out of the blue i received a letter from northampton county court with a statement prepared by some solicitor claiming that i was the driver and that i had been driving along the road when i carlessly lost control of the car , veered across the road and collided with his clients vehicle , all this of course is completely untrue and absolute nonsence . there is a claim for £360.00 in repairs for the damaged car and £50 solicitors fee and a further £50 court costs . could someone please advise on my best course of action here , there is a letter / form attached with the paperwork for me to respond but im not very clued up with the legal system .
  7. hello all , ive just been sent a letter from the dvla to inform me they are taking court action against me for failing to notify a change of keeper ( the v5c was returned but no surprise there eh ). i previously wrote to them explaining i had in fact sent off the v5c all filled in and i would robustly defend this if i was taken to court i also asked for full details of all lost or misplaced post within the dvla but as i expected i did not recieve this information . my question is do i need to send a payment to recieve this information as i think i should from memory is it a £1 or some such amount . also how long do they have to send me such information as i will be useing this as part of my defence in the forthcoming court action any help here would be appreciated .
  8. hello , im looking for a little advice if possible about lloyds bank swallowing up my benefits . ive only just found out from searching these forums that the banks are not allowed to take monies paid in dwp benefits to cover charges . im going back to january 2008 - november 2008 when i was claiming benefits due to a serious heart complaint , the dwp paid my benefits straight into my bank account at lloyds then, lloyds immeadiately took all my payments to cover overdraft / credit card charges at the time i thought they were entitled to do this . but for my family helping me out financially i dont know what i would have done as i didn`t have so much as a brass farthing to my name . to cut a long story short i ended up losing my house ( could`nt pay the mortgage ) i moved into rented property , i also opened an account at a different bank and have my benefits paid into there now . what i would like to know is , is it possible for me to claim back the payments made to me by the dwp during that time and if so who do a write to ? my local branch ? or have i left it too long ? . any help or advice on this matter would be great as i would love to be able to offer my family some money back for all their help .
  9. problem solved , i went on line this morning and paid the council the £82.00 parking charge so as far as im concerned there is now no debt for the bailiffs to pursue and , if the bailiffs want their fee`s then they should contact the people who employed them i.e bolton council ! . thanks to all for your help .
  10. no sorry there is no mention on the letter about the outstanding amount but , as i understand there is a fixed amount they can charge anyway ? .
  11. last january my wife got a parking fine a letter from bolton council came addressed to me as i was the registered keeper . thing is it claimed to be the 2nd letter and demanded £80.00 iirc ( i never got the 1st letter giving me chance to pay £30.00 ) i called bolton council to ask why i had not got the first letter and they just said well it was sent to you i also asked to see photographic proof it was actually my car , i recieved nothing !. i then chose to ignore their letters as they had ignored my request and today i have received a letter from equita bailiffs say in large red letters REMOVAL NOTICE . i contacted bolton council who told me i owe them £82.00 which i then offered to pay but they refused to accept my payment ? what i would like to know now is can bolton council refuse my offer to pay in full ?. if so what happens next as far as this bailiffs letter goes and what charges can equita load on top of the £82.00 that i own to bolton council .
