  1. The woman who told me from FOS did not know what the amount was! We have not seen or signed anything, I think they are going to fob us off with some paltry amount, and deposit it without sending us an offer, so we can't refuse! Not happy, finding it all v stressful and feel helpless!!!!!

  3. FOS have just emailed to say BC have told them our complaint has been calculated, and that a payment will be made no later than this Friday........um, what paymen??? We have not even seen an offer? I know we signed the agreement from FOS, but I thought we still got the offer letter with an amount from BC, and then we would decide whether to accept or not???? Is this the way it is normally done when dealt with by FOS???? What if we do not agree with the amount?
  4. Thanks...I was a bit excited when I saw a memo text referring to "Copies to correspondence PPI Glasgow Jan 01 to Apr 04", even though all we have received is from after that, and have been categorically told, in writing, they have nothing further....
  5. FOS have been back in touch, fixed the error, a nd I have to say, the three people I am now dealing with are fantastic. Great apology, a promise by the manager to personally monitor both our cases, and a compensation payment-small, but still nice! Now e have to wait and see what BC come up with on their offer.... ....1994-current date PPI, high balances from 1998 to 2003... .I bet they send a very low offer, but steadily accruing info to back up higher claim. We shall see... .also, have sent more info I found in the paperwork they sent us to ICO to suggest they do have more info/statements than they have provided us!
  6. No, but they still fall under Code of Conduct or some such, if you have a look through the forum, you will see heaps of instances where they have not only reviewed, but found in favour for cases from the early-mid 1990's.
  7. Why do you say you will need to go the court route, is it because the loan was taken out previously to 2005? If so, that is not correct, FOS will investigate older claim than that.
  8. Just sat down to do some proper reading through these computer printouts BC sent us in response to DSAR, and have found some interesting info: 1. The date and amount of each credit limit increase, some very close together, which to a logical person would suggest the NEED for an increase. 2. A transfer amount in 2002, when we went from Gold to Platinum card. 3. The lifetime highest balance!!!! Which is much higher than any of the statements we have. That balance, coupled with the transfer amount, and the credit limit increases, I believe put a lot more wieght in an educated guess of the balance-best of all, all info they provided us! So except for the ppi averages, al the other info came from BC. I was just thinking pretty solid case to argue average ppi amounts in the absence of statements?

  11. I know all that, have done it with this and HSBC, when I said about estimating, I meant for the preiods in the past where we don't have records and BC are saying they don't have records.
  12. Now, we don't, but FOS said they are now estimating it based on recorded usage?
  13. Not sure how to recalculate the offer at this point, as BC have been sticking by the 6 yr rule. How, however, I understand that a lot of banks are now estimating lost payments, anyone had any experience with that?
  14. FOS are taking it on the chin, saying they had to convey that message for us to accept to deal with BC, it is just really disappointing!
  15. Wow, so a bit of an update, emailed FOS a week ago to see where our case was at, no reply, so bit the bullet and called them today. After looking at our case, they asked if they could call us back, they did, and it turns out BC upheld our complaint in last April (!!!!!!!!!!)...but FOS have not got back to us. Quite the opposite, I emailed every two months for an update, and even early Dec was told in reply that it was still waiting to be assigned to a case worker!!!!!!!!! So not happy. Am waiting for a manager to call back. How do I complain about the FOS???????
  16. Hi Scoobied, thanks for some partly positive news! Hod di you get them to go back to 1989, did you have the statements, or did they end up producing them? How long did your case take, ie when did you log it and when did you hear back about it being upheld? Sorry, lots of questions!
  17. This case has only been with FOS for 7 months, so still a while to go, anyone had any luck getting accepted offer increased by FOS?
  18. Well, almost 13 months to the day since we referred the case to FOS and....NADA!!!!!! Have just emailed them again to ask if our case has even been assigned to a case worker yet???? This is very frustrating! HAs anyone else's case with the FOS taken this long?
  19. Who are you doealing with? Just make sure the requests are not being handled by the Regulated Sales Complaints team, as they will say all they have is the 6 years of records. You need to make sure you are dealing with the Data Team UK. If you ring the regulated sales number, ask for the Data Compliance team number. I ended up with HSBC cc statements back to 1997 for a card taken out in 1995. However, the account is still active, so not sure if that makes a difference. GL!
  20. Phew, have finished preparing our complaint to go off to the FOS, not even sure if they will look at it, but never know. This makes me so mad, you have people on Sky News saying don't go to cc, banks will be fair.....yeah, right!!!!!!! Don't misunderstand me, not saying cc are any better, but really, consumers in this situation are at such a disadvantage
