  2. It's my understanding that you can ask the brewery to supply you with paper, computer records and other related info. The max charge for this is £10. Notes, screen notes, recordings, external correspondence, copies of letters and copies of emails all fall under the DPA so should be released to you, but i would be surprised if they released internal correspondence as that tends to be privileged. Re transcripts of phone calls, very few breweries record them so odds are they won't be able to. Re them denying they were previously advised about the faulty electrics, when was the last safety check carried out? I'm assuming you've asked for copies of the reports - they tend to be landlord responsibility depending on the term.

  4. daverules - If you pm me with the name of the pubco I may be able to help. Do you know if the annual electrical safety checks are your friend's liability under his Lease, or was it Landlord's F&F that caused the fire?
  5. Hi, I've never dealt with the chap, but a quick question; is he a registered paralegal or just someone who does a bit of legal work and calls himself one? If he's a registered paralegal (i.e. Qualified) then submit a complaint to the Institute of Paralegals (IoP) as Paralegals have to work to certain guidelines. They're not as stringent as those for solicitors, but they can strike him off their register. Cheers and good luck ! Dodger
  6. Hi, This is the root of your problem. Once the Sheriffs Office has been instructed by a creditor or their solicitors all payments towards the debt must be made to them. If your creditor's solicitors have been accepting payments from you, provdie the Sheriffs Office with the details (i.e. payment amounts and dates if you have them, plus make sure you tell them they have agreed the new payment plan of £50 per month) and they will take it up with the solicitors for you. I do agree with the others though, you should try and get this back in to court so the payment plan becomes formalised and you avoid the costly bailiff fees. My advice, make an application to set aside the judgment at court (costs £45 off the top of my head) and lodge an income and expenditure form showing what you can afford to repay(go to the CAB and complete one there as they carry some weight in court).   7. Hi all, This is my first post on here and as there are already ALOT of posts on here about these con-artists, apologies if i've missed one that already answers my question. Does anyone know whats going on with Welcome Finance? I understand that the FSCS has taken over their PPI complaints and have placed them in default rather than allowing them to go insolvent, but where does this leave people with existing loans that, for one reason or another, aren't repaying them? A quick scenario for you; - I took a loan out as a last resort to pay my rent 4 years ago to stop myself being made homeless - I maintained the repayments for circa 6 months, but circumstance made me default (i.e. lack of money) - Like an utter coward, when my bills got too high, I ran rather than trying to sort things amicably - I have not acknoweldged the debt in 3 and a half years, nor do i intend to (now i am back on stable footing, I did think about trying to repay it but it angers me that 1: they gave me a loan when i clearly couldn't afford it and it was 'the straw that broke the camels back', 2: the amount i borrowed was £1k, but now they claim i owe £7k and 3: they sent a debt collector to my door who physically tried to drag me outside by my shirt front when i refused to let him in to my house - The account is not set as a default on my credit report but instead shows as a late payment. I suppose this is to prevent it dropping from my file? Does anybody have any advise on what i should do? I'm inclined to ignore it for another 2 and a half years so it becomes statute barred as it's been 3 and a half since the last acknowledgement, but will it stay on my report? Thanks in advance. Chris
