Hello, make sure you hound moorcroft til you get this letter, then copy it and send it to t-mobile. you can ask them to remove the default as you have paid the account a long time ago, they may or may not do this all you can do is ask. As for them not recieving any funds from moorcroft, t-mobile need to take that up with them. Someone else with more knowledge may offer alternitive advice or how to proceed if t-mobile aren't playing nice with you. Again good luck.

Hello, I had the same problem but mine for £20.00 thankfully. account went into the red, got runaround for months in the end phoned them to take me court, they had all the info they needed umpteen times, got sick and started harrassing them on the phone, mine was just a [EDIT], left positive feedback and it was 11 weeks before they did the chargeback, I got my money back eventually, but account now dormant, and the [EDIT] lives in a holiday destination, never been there before

Hello, is there a referance on your credit file for it? if not get in touch with T-Mobile and ask what their reference number was, and go from there, Moorcroft will be able to find you, they just won't want to bother, so when you find this info out, do a data protection request on them. Good luck, for what it's worth I found moorcroft don't care, once they have your money.

Hello, I feel you should send the CCA request first to the people who are collecting the money, send them this with the £1.00 fee, as you have been paying pay this next installment, once 12 working days have past THEN stop payments as they have then defaulted, after a futher 1 calendar month they commit a criminal offence. Seand the original creditors the SAR asking for ALL information on you. They have 40 days in which to send this information. It is the CCA that puts an account into dispute. Good luck.
  6. hello, call your council, I have also had this, in order not to pay the charge I had to set up a direct debit, and they only take the money owed not the costs, this may be just my local council but worth a try, have to add if I paid over the counter in cash they would still charge the court fee, strange.
  7. hello, Yes you need to send a CCA request to them together with the £1.00 fee, keep paying until 12 days have passed, after a further working 1 calendar month they commit a criminal offence, unless they they provide the agreement(s). I would leave the opening statement in the request, but that's me. For the statements and charges side, you need to send a SAR Data Protection request, together with the £10.00 fee, they have 40 days in which to supply the information. State that you want all information they hold on you, full disclosure. Good luck.

  9. Hello Sandrock, if you have entered into any sort of arrangement to pay, keep going til the 12 days have passed and they are in default, so you can then stop paying. If no arrangement is in place, then personally I wouldn't pay anything til they prove the debt.

  12. Hello, wecome to the site, you are not alone here NO, they are not allowed to do that to you, if they won't listen to you, place the phone down gently, and go make a cup of tea or coffee. Pick the phone up gently, if they are still on line, ask if you can now speak and tell them you will only deal with them by letter and say firmly goodbye. First, send them a CCA request, template in the library, once you have done that, read all you can on the forums, this place is fantastic. Second, do you have/had any charges with Cap 1? If you do have/had charges added to the Cap 1 account, send Cap1 a S.A.R - (Subject Access Request) - data protection request unless you have all your statements, again a template letter is in the library.   13. Hello, you don't say how long you've had the account, is it more than 20months? If it is then send then a SAR data prtection letter asking for full disclosure, along with a cheque/postal order for £10.00. that way you'll find out exactly how much they owe you.

Hello, yes, originally I sent preliminary and LBA without, but finaces dictated that I couldn't afford the fees and have the money for AQ when it arrived, (have learned from previous mistake) so waited til I had the funds saved. Then Cap1 in their wisdom wrote telling me they had sold the debt to Lowells, so now going for the interest and default removal.
  16. Hello Jaffacat, I to have a debt from cap 1 that has been sold to these people, yesterday I sent them a CCA request, so they have to prove they have a right to collect. I have also sent a prelim to cap 1 for charges and compound interest. There is a letter somewhere on the forums telling them to desist from phoning you using legislation,though can't remember where I saw it, but someone will come along to guide you. Or you could search for stopping telephone harrassment. best wishes sent to you.
  17. Hello, an udate. I'm here to get/recieve a big fat kick up the bum. But it could go to help saving someone else from making the same mistake as I did. I got the AQ, filled it in and because the amount I was claiming was less then the £1,500 I didn't pay the £100 fee. The court sent back the forms saying I had to pay by the Monday before I got paid again or it would be struck out, (they take the whole amount, as from the beginning of the claim) so went up on the Wednesday with the money only to be told that I would have to pay an extra £60.00 for the magistrate to reinstate the claim. I didn't have the extra so have just let it lie. My own fault as obviously didn't check as much out as should have, so please no boots bigger than size nines. So I do have a question, Is it possible to start again from scratch from where I left off? meaning do a preliminary for the balance that has been struck out, or do I just have to cut my losses.

Vampiress's spreadsheets have so much stuff on them, and for my original claim I used the free office one, but now I want to go after Cap 1. You have inspired me.

Hello, You are going to be okay, you have come to the right place, contact the C.A.B. or the CCCS. and ask them to help you, they will contact all your creditors and get the interest stopped, they will also negotiate with the creditors for a minimum amount to pay. I know it's easy to say but try not to worry, once that's sorted come back and start getting unfair charges etc. back. This is a new year so a new start.
  20. No, you can get the recorded slips from the Post Office prior to writing, that's what I was doing for selling on Ebay.

    Here, here, I totally agree, my agent was a bully when I first met him, threatened me with loads of stuff, it wasn't til he realised that the house and everything was in my OH name he quietened down and became civil. And then the power, the feeling of they can't hurt me, once you know your rights and they go away disapointed because they now know that you know what they are up to. I'm really chuffed for you, give your OH a big cuddle and yourself a pat on the back. You can relax over xmas now, you have us behind you, to help and encourage, then see what the new year brings. Again well done.

    Hello, you have sent the right letter, that is similar to the template. I see your letter is dated 13/12/2006, if that is correct, then you will need to keep paying him til the 12 working days have passed after delivery, did you send the letter recorded delivery or special delivery? If not did you get proof of posting via the post office? You can expect 2 days for delivery but one of the 1st two options then check delivery progress via the Royal Mail website. Once those days have passed Moorcroft are in default and you can stop paying them. They then have 1 calendar month before they have committed a criminal offence. My advise would be, contact Moorcroft and offer to pay this fortnights payment via a card to stop their representitive from calling tomorrow. Hope this helps.

    Hello, you say you have sent a SAR, I sent a CCA request to Moorcroft and have had 2 phonecalls and 1 visit, and on all occasions have stated that they have committed a criminal offence as nothing was sent in the prescribe timeframe, They did send the agreement but too late. I also wanted to know if they were agents or owners still not heard anything. So I would advise, send off a CCA request, wait the 12 days after reciept, then you can legally stop paying them anything.Then the 1 calendar month then you can throw the criminal offence at them. Hope this helps.
  25. hello llandegla and apples, I would advise you keep reading the FAQs and all the threads in the forums you're claim relates, also you need to have your own threads, so people can see where you're up to. as for your dilema now, write back accepting the offer BUT only as partial settlement, make sure you let them know you will be going ahead for the rest. keep going you will get it back.
