Thank you phunkeymonkeh, I am currently still in the process of taking the Halifax to court for years 7 & 8, they have til the 7th November to file the defense, so will wait and see for that bit. Thank you also to Aitken Brotherston, I had charges but no idea how much, so would you suggest the follow up of the DPA for none compliance, or a preliminary for a guesstimate of charges?

Hello again, could do with a bit of help Please Today recieved some info from the Co-op, all in code, nothing to decipher it. No statements or list of tranactions. Have phoned them and they say everything is removed/destroyed whatever, it's gone after 6 years. they have given me data going back to 10/07/98, but there are no statements, I asked about microfiche and there was no comment on that, just they don't keep data longer than 6 years. Can someone guide me, the DPA time limit is up on the 5/11/06. I know there is a follow up letter but can anyone confirm that they won't have the info or is it worth persuing?

Hello, you can try this account queries, 0800 9522244. I had my acc no. so used button 1, however you could try pressing 1 then when they ask to key in you acc no. press the # key, * , 0 or just wait for them to answer, being a freephone no. you can each or all of the above

Hello, to find out my details I telephoned the Recoveries Department on 0161 8294376. I spoke to a David Jones, he was very helpful and found my details. Hope this helps.

Hello Number6, the post above clears up in simple terms my CCA,however they defaulted me and have since sold the debt on to Cabot. Can Cabot after failing to adhere to my CCA request, still use this if they ever get it and go to court, as the agreement is cancelled/defaulted? -
Hello Hollydoll, write and accept as partial payment only, if the 14 days are up do the N1, they will pay you all the money and the Court fee, I got part payment within the week of N1 being filed, my claim not yet finished but it's your money, don't let them keep it. YOU WILL get it all back

Hello, an update. On the 23rd September I sent the CCA request to Providian, they defaulted on the 11th October, on the 19th October I recieved from them a copy of the application card that came through my door informing me I had been preselected for a credit card. It does have on 1/2 of the copied bit the words Declaration Credit agreement regulated by the consumer credit act 1974 I am applying for a Providian credit card and PIN and cheques, subject to status. I authorise you to send me a Providian Visa card. I accept and agree to be bound by the providian credit card terms and conditions. I am a uk resident. Please reply by 29th December 2000 they have also stated in the letter that their records show they sold the debt to Cabot Finacial (UK) on 30th October 2003, but no letter confirming this. So would this be the CCA request fulfilled ? If anyone could confirm please.

Thanks Andrew1, had read that thread but not til after I had written. the debt was purchased by Cabot Europe ltd and the default is kingshill no.1 which is the other group. would I have to CCA Kingshill no.1 as well?

Hello Hairyman, I have long passed the thirty days bit so they can't come after me til they get any paperwork and go to court. Don't write to them, they know or should know what they have to do. This is a waiting game now. I wrote to them informing them that I now wanted my default removed, still waiting for a response.

YIPPEE CAN'T STOP SMILING Have got the cash for 6 years into my bank today, can wait for the other 2 years they are not paying as yet, but we'll see hehe that's my annual bills paid. will donate tomorrow when transferred the money into parachute account hehe, chin up everybody, YOU will get it back.

Thank you Jonni2bad, deep down was hoping you would come to my aid and give me the courage not to walk away and possibly regretting not following it to the end. It's much appreciated and what I wanted to hear, no offence intended toward Returned to Sender, if I was answering someone who was asking the same question, I would probably answer the same way.

Hi, no they are willing to pay 6 years but not the previous 2 years, I'm claiming 8 in total from when account 1st opened

Hello, good and not so good news. They have acknowledged to the County Court, and Purely on a commercial basis are willing to reimburse me 6 years fees, interest and court fees but are not accepting the 1st 2 years as they are saying they are statute barred, which equates to £298.90. I have 7 days in which to respond. Any advice or suggestions will be considered. Thank you in advance.

Hello, I have just submitted my claim and it goes back 8 years, Think about whether your charges go over £5,000.00 in case it goes from small claims.

Well, have finally done it, filed it and got the claim number, deemed served yesterday. I can't believe a shy bairn lke me is taking somebody to court, thank you to all at this site for giving me a back bone.

Hello, I have only had diect debit charges so here goes 1998 - 2000 £25.00 each 2001 - 2002 £28.00 each 2002 - 2004 £30.00 each 2005 £35.00 2005 - now £39.00 each hope this helps
