  1. Thank you for your reply, I have charges on the account, the CCJ is no longer on any credit ref.files, and equidebt have owned the debt for 4 years, I still have over £300 to pay. I'm sure it was 1999 when I got the CCJ, so wasn't sure if the Co-op would still have or would give me any statements. Still it's only £10.00 to find out, will be nice to find out.

  3. hello, James J, can you answer me in plain simple terms,(I'm not the brightest bulb on the xmas tree) If you are the gatherer of information, public and private, I sign a form to say joe bloggs can access my file for credit reasons, ie, name, address, D.O.B. and any other public stuff, why do you give them my private information? What I mean is If I tell John something that is common to all (if they look for it), and I allow Bob else to ask John about it, I don't expect John to tell Bob anything else. I know what I'm trying to say

  5. Hello, I had a current account with the CO-OP,got into difficulties (charges). Took out a loan to cover them, you can guess the rest. This account under normal circumstances would be statute barred however I am still paying Equidebt, who OWN the debt now. There is nothing on my credit files for this, so my question is Will I still be able to get copies of statements to claim from the Co-op as it is still subject to a CCJ?

Hello Pugsley, I don't know if you're a council house tenant or not, but we got our insulation via Care and Repair, we had to go all around the houses to find the information but, they provide the grants for this and most other repairs. Ask at your local council, telephone suppliers of the insulation they are usually very helpful, if they can't help, then ask if they know someone who can, that's how we did it. Hope that helps
  8. hello, we have an electric pre pay meter, we were with NPower,switched to British Gas, we were with them 1 week and the cost had doubled so had to wait 4 weeks to switch back. All we had to do was wait for new keys, no charges for swapping, no meter changes, nowt. If you know who is going to be cheaper for you, do it manually, then you are dealing direct, you never know your present supplier may equal or even better the deal.

  10. hello, recorded delivery is treated exactly the same as normal mail, you are paying for a signiture. I too have `lost' 2 letters with Postal Orders in them, they have been delivered as I've had a responce, however, track and trace have not delivered them so, once the claims have gone through I'm serously contemplating placing a claim with royal mail, as they have not supplied the service I paid for.
  11. Hi Woozie, did you check with track and trace online for when it was delivered? I did but have since `lost' 2 recorded since so the last one to Halifax the LBA went special delivery. Couldn't really afford it but thought got to be sure they get it, and they did, no probs. I have since spoken to a DCA, and they recieved the recorded letter the day after posting, it still hasn't been delivered according to royal mail. So tempted to claim from royal mail for lost post, and claim the fee back because I was paying for a signiture and didn't get one. Hehe 11 days and counting for you, we are all with you.
  12. Hello again Woozie, again chin up. I went to the nat west, they are really friendly with me. Though I haven't checked out their charges, not planning on getting any, Did you get the person's name who accused you of fraud? Can you find out if the conversation was taped? How old is your daughter? Could she threaten them with legal action, as obviously she's not you. On a brighter note your nearly finished with them, though I think you'll beat me, cos the fee for court is going to take me a couple of weeks. Take care, think positive, you're nearly there, you WILL wipe the smug smile of their face.

Hello David M, in the templates library their is such a letter http://www.consumeractiongroup.co.uk/forum/bank-templates-library/114-template-letter-your-member.html Also check out if your MP holds surgeries anywhere in his area, mine has a surgery once a month where you walk in off the street, he's only there for a couple of hours in each town centre but at least he's available. Alternitively, go to the office and insist on an appointment from his secretary/personal asssisant who will be at that office, YOU do have the right to speak to him. Good luck.
  15. Hello, there is nothing written down about this for England and Wales. The government were talking to banks apparently, but that's as far as it got. We all need to write to our MP's, regarding this, they in turn should then write to Mr Ed Balls, the Economic Secretary to HM Treasury, Mr Balls is the government Minister for the banking industry. The more letters he gets, the better chance we have of getting legistlation regarding state benefits.

  17. Hello, I have scoured these boards for weeks and weeks, there is a thread that guides you on debts that are over 6 years old. I can't recall when I saw it or what the title was, but as long as there's been no admission of the debt by you for 6 years, they can't enforce it. however, someone more experianced will come alone and guide you properly. Keep reading the threads, it may have been in the bailiffs and debt collecters forum, just keep reading ,the answers are there, just takes time. at least this keeps your post on the front page. good luck
  18. Hi, another update (mainly for Jonni2bad) regarding my MP. I recieved a response from him this morning Thank you for your recent letter regarding disproportionate penelty charges levied by UK banks. My apologies for the delay in responding. I can appreciate your concerns and have written, on your behalf, to Ed Balls MP, the Economic Secretary to HM Treasury. Mr Balls is the government Minister responsible for the banking industry, and I have asked him to look into your concerns. I shall of course inform you of the Minister's response as soon as I recieve it. I hope this is of assistance. Best wishes, Yours sincerely I didn't actually write to him, I spoke to him about this and he took notes regardin this. So I will post any other reply.
  19. hello again, just to update my thread, today I sent via special delivery the LBA, I wasn't refunded £28.00 as stated in their letter, they refunded/reversed a £39.00 charge from 6th july 2006. every little helps. so roll on 31st August to go to court and make a claim. will keep you posted, 2nd off last hurdle now passed, money come home.

    hello, I opened a step account last month, before I had seen my credit report, and was accepted via an in branch application, I have 3 defaults dating back 3 years. credit file is next on agenda after my bank claim.
  22. Hello eveyone, glad to see you, as Welly has said all the info is in the FAQ's and then some more in the different threads, this is a brilliant site. To Jane Cooper, I am also not up tp scratch with computers, so I copied and pasted the letters to Word or your equivalent, then added my details, saved it and printed.   23. I have today received this responce from the Halifax I write in response to your recent letter regarding the above account. Naturally I am concerned that you have found cause for complaint and at the outset please accept my apologies for any inconveniance this matter may have caused you. I appreciate your concerns about the above account and note that you are aware of the OFT's statement published in April regarding default charges. We disagree with the legal analysis of default outlined in the OFT's statement, but are at this time working in conjunction with the OFT. Although they believe charges are to be no higher than £12.00, there has not been any legislation which could force us to reduce our chargeson our bank account products at this time. However, the group have confirmed that it will be reducing default fees accross it's credit card product range to £12.00 from the 1st August 2006. Unfortunatly it is not possible to provide you with a breakdown of how we arrive at the level of our charges as it is an internal policy and is different for each type of charge. However, please accept my assurance that our charges on our bank acounts/credit cards are a genuine pre-estimate of costs that generally arise when customers breach their agreements with us. They cannot take into account the individual circumstances of each particular case. In the circumstances we do not agree with you that they represent an unlawful penelty or unfair term under the Unfair Terms in Consumer Contracts regulations. It is the customer's responsibility to ensure funds are available to cover direct debit/standing orders, cheque payments and also charges due to be debited from their account. We give an adequate notification period of up to 28 days to allow you time to make provision for pending charges and also advise that you will recieve further charges if your account is not conducted in line with terms and conditions. I have as a gesture of goodwill I have refunded £28.00 worth of charges due from your account to avoid escalation of your balance at this time. I am unfortunitly unable to offer you a full refund of all the charges debited from your account over the past eight years. I am sorry that this letter may not provide you with the responce you are seeking however I trust this clarifies matters for you. You will find enclosed a copy of our leaflet explaining our complaints procedeures. Should any of your concerns remain unresolved please let me know what you'd like me to do to put matters right. We are keen to resolve your concerns, if we are unable to do so we'll provide you with details of how to contact the Financial Ombudsman Service for assisstance. If I do not hear from you within the next eight weeks I will assume you are satisfied with our responce to your letter. I like the way they say they give up to 28 days notice of the charges being applied, I get 7 days from date on letter. Also so far no refund of £28.00 and no charges except interest are due, my charges have also been £39.00 each time! so does that mean there will be no refund of £28.00

  25. Hello again, just an update. Recieved my bank statements for the whole of my banking history with the Halifax. (Boy am I dissapointed, have managed my account better that I had imagined) Total charges owing £1441.26 inc. £4.26 in interest. (not the 8%) So I will be be more than happy to donate to this fantastic site. Also my claim is for 8 years worth of charges, they have til the 11th August to respond before LBA. Johnni2bad- with regard the benefits and charges, I wrote adapted the letter to your MP template, handed it to him, and he doesn't know of this, however I did find reference on page 2 of vampra's thread `carer incurring excessive fees @ natwest' then someone relates to Social Security Administration Act 1992.
