  2. My slant is that if the debt isn't being actively pursued or your are playing letter tennis with a DCA, then let the sleeping dog lie. If it threatens to go near a court, then perhaps time for a rethink.

  4. £30? If you do actually owe it (and I mean you actually used the overdraft, not a legal argument) and can afford it, why don't you send a cheque to HSBC and forget about it as it does seem like a lot of hassle for a relatively small amount. Also this method bypasses Robinson Way.

  7. Thinking this through, the employer basically wouldn't have to give a reason for dismissal so any discrimination could be concealed. Hopefully a step too far, even for a Conservative government.
  8. Thankfully this is only a report and it sounds like it will go no further. However, if it did go anywhere one would hope discrimination would be safe guarded. It would also more or less be the end of the contracting industry and temps and 'permanent' would more or less be the same thing!

  10. I would be cautious that they don't just take the old 'debt' out of your account when you set up a direct debit.
  11. So what legislation makes it illegal to have holiday while sick? Even if such legislation exists, who is going to complain if both sides agree it as a compromise?

  13. I work in IT so I am used to people disappearing quickly! Someone else with more knowledge can advise on the redundancy process. If there was another person doing the same job who could have been made redundant (which going purely on what you have told us could be the other project manager), the company should have come up with an assessment criteria for everyone at risk possibly including (but not limited to) things such as sickness, salary and skills needed for the job. Anyone at risk should be assessed using this criteria and the lowest one made redundant. I am not sure you have a legal right to see it but when it has happened to me in the past it has been offered to tell those affected what the criteria was and who you fared in it (although not how other people did).

So long as they have followed a demonstrable selection process for the redundancies (which can take into account how much people are paid relative to each other) they can generally pick and choose who they want to make redundant. This isn't to say some companies don't pick who they want to get rid of then retro-fit the criteria, but either way it is difficult to overturn. However, you can certainly ask what selection criteria was applied and the redundancy process should have been followed (e.g. your role should have been identified as being at risk). In terms of redundancy payments, they don't have to give you anything if you haven't been working for them (not freelance) for two years.

  18. I don't think you legally have to advertise it externally BUT if you employ someone who needs a work permit you have to demonstrate it has been advertised properly in this country. It could be an internal rule, however.
  19. I wouldn't have thought so as there is no legal reason they have to do business with you. However it is bad form so your local Trading Standards might 'have a word'.
