  1. hi PJH, in fact my last two paymenst were both £10 more than the agreed amount. I finally got to talk to a guy at Andover, detailing my complaint that despite me having repaid approximately £400 pundss that my balance was no better than when i started as a result of the charges they continue to aply outstripping the agreed re-payments. I also pointed out that they keep reducing the o/d limit below the balance of the account triggering more charges. the outcome was re-setting the o/d limit to prevent further charges being incurred, and i know have the exact details of how and when they reduce the o/d limit. so at least i wont incurr further charges, and that puts me in a position now to start my claim against them to recover all of these charges:D

Here is the letter i intend to send to them, Dear Sir/Madam I do not acknowledge any debt to your company I refer you to my letter dated 07/09/07 which was delivered via recorded delivery to your offices on 10/09/07 In my letter I made a formal request for a copy of the signed, executed credit agreement for the above numbered account under section 77(1) and section 78(1) of the Consumer Credit Act. In addition a statement of my account should have been sent along with any other document mentioned in the credit agreement. The Consumer Credit Act allows 12 working days for this request to be carried out before your company enter into a default situation. If the request is not satisfied after a further 30 calendar days, Your company commit an offence. These time limits expired on 25/09/07 and 27/10/07 respectively. As you are no doubt aware subsection (6) states: If the creditor under an agreement fails to comply with subsection (1)— (a) He is not entitled, while the default continues, to enforce the agreement; and (b) If the default continues for one month he commits an offence. Therefore as at 27/10/07 this account became unenforceable at law. Furthermore, the document you have supplied with your letter dated 06/12/07 does not correspond in form and content to the requirements of the Consumer Credit Act 1974. Any earlier actions relating to sharing of data with credit reference agencies or defaults should be immediately removed. Confirmation and acknowledgement of this letter should be received within the next 14 days Yours Faithfully any comments or advice?
  6. not heard anything for months on this, should i be writing to capquest and cap one and requesting my balance be returned to zero and any defaults removed ?
  7. a few years ago CO-op visa sold my account to equidebt, even though i was up to date with my agreed arrangement. I have ontinued since then to pay £50 a month to equidebt, however in septemebr i stopped paying and sent the a CCA request. they failed to supply a true copy of the fuly executed agreement in the 12 + 2 days, and this default has lasted more than one calender month. they have finally supplied a document ( my cca request was 07/09/07) on the 6th decemeber. This document is lcelalry an application form as does not contain many of the prescribed terms that are required.. i will scan what they have sent for others to look at.. but it is pretty similar to the one i had from cap one which was not enforecable...
  8. another letter from LTSB , under their new charging scheme they are taking £165 from me next month in unplanned o/d fee's... about to send a letter to collections centre... will quote the conditions of the waiver as pointed out by els... had a conversation with some indian call centre from the colleections department.. what a waste of breath... went into the branch to complain... they said they cant discusss it if collections are dealing with it... so right now lloyds charges are outstripping my agreed repayments.. because lloyds keep dropping the o/d limit below my balance every time i make a patyment and trigger more charges.. if this is not customer abuse i dont know what is!!

  10. reading this thread with interest as i have similar issues with LTSB. Earlier this year they hit me with approx £380 in charge over three months , so i began the process of preliminary request etc. I started to pay all my salary etc into a different account. Collections centre started to chase me and i agreed to pay in £50 every 2 weeks until the balance was cleared. Lloyds then set this up as an overdraft even though i did not ask for one, and each time a payment was made the overdraft limit was reduced. all sounds fine until ltsb then started to reduce the overdraft to a level BELOW the current balance each time i made a payment, and then started to charge me £30 each time they dropped it for being above my "agreed overdraft" (bearing in mind i didnt ask for one so how could it be agreed). yesterday i received the letter of their new charging structure re daily fees for up to 10 days for unplanned overdraft, and today they have added £60 in unplanned overdraft fees!!!

  15. ge's solicitors advised me that the money had bee credited to my account, my latest statement shows this not to be the case. I have spoken to customer services who have confirmed there has been no such credit. So , re the warrant of execution, is there a charge for this , and how do i apply?
  16. ok to update..... after much toing and froing.... i decided to accept the terms and conditions to get a faster settlement. normally i would not accept any t&c's but looking at it overall, this is the second claim for charges on this account, and the account is now nearly cleared at which point it will be closed, so accepting T&c's would not be unduly detrimental to me as a future claim here is most unlikely. anyway, the court approved the draft order submitted by GE solicitors and signed by me, which was basically payment in full without any admission of liabiltiy, some confidentiallity stuff, and payment to be made within 21 days of date of order. the court approved this, but 35 days have now passed and no payment received..... so i am right in thinking i can go back to the courts on the grounds that ge have failed to comply with the order?
  17. apparently the PC brigade are looking to ban the red arrows from performing at the 2012 olympics because it is too militaralistic and may offend others .... bah humbug.. 1000's upon 1000's of people all of the world have enjoyed their displays of skill and precision flying.... whatever next eh? Petition to: Allow the Red Arrows to Fly at the 2012 Olympics.
