  1. What would you say is the best way of responding to this then please?
  2. Is there a letter I can send back ro them then? My wife has a similair agreement with them, so I could kill 2 birds with one stone. Which would be nice.
  3. I sent them default letter in early Jan, they sent back this letter: I liked the bit where they say they are not prepared to enter into repetitive correspondance.... So I sent them the Account in dispute letter in late Jan.

  5. Hi folks, after a cca request to Nat West I recieved the following documents. A letter telling me thatthey had complied with the cca request, page 3 of 12 of the terms and conditions of a credit agreement which as far as I can tell doesn't have the prescribed info on it, and an un numbered sheet (clearly therefore not part of the 12 sheets as above) with some more terms and conditions on. I think therefore that tis agreement is not valid. Any expert opinions please and what do I do next. PS I have just had a letter back from Fentons/TSB ( not the nat west which is this thread) telling me that as they were unable to locate the required info, they have closed their files! Thanks CAG and everyone for all your help. I think thats whats known as a RESULT.
  6. Ask one of the DCA to do it for you. I think you will be hard pushed to get them to do it though, especially when they realise you aren't bluffing. The other reason they won't do it as they lose control of the amount you alllegedly owe them - it all goes through the courts, so they will end up with virtually nothing, yet have paid out some quite high fees and costs. Read some of the other stuff on the site, and depending what they are chasing you for, they might not have a legal right to ask you for anything.
  7. If you have a joint bank account, or friend/wife has their own account, get them to send a £1 cheque for you.
  8. She has been paying £10 per month for about 3 years now, ever since I lost my job. She signed up in happier times via the internet in 2001 . Why might they default it now, and why might that bring better news?
  9. My wife CCA'd the RBS regarding her credit card. They have sent back a copy of her application form (below) and a copy of a 7 page Credit Agreement. The copy of the credit agreement is unsigned (in fact there is nowhere on the agreement to sign) so I imagine if thats their best effort, the agreement is unenforcable. What do you think folks.

  11. No consumer Credit Licence? Surely they cannot trade in that case. Sounds very illegal to me. Wonder what the law says about that.
  12. After sending Capquest a default letter i got this back from them. I think they are wrong.
  13. If you have no money, the courts can waive the fees. Always seems strange to me that people get ccj's mainly because they have no money. Then in order to sort stuff out, they want loads of money.
  14. It's just that I might be getting accj from a company I used to have a franchise with. I was ill and unable to carry on doing that job. I had sale orders for about £6000 which, unbeknown to me, they passed on to other sales people. They also terminated my sales contract without following their procedures. On the basis that they owed me more than I owed them in completed orders (Customers paid me in cash) i told them to call it quits. They are now taking me to court. Very tricky to defend and prove (they are a large company that coincedentally now has a sales staff turnover of some 45% p.a). If they succeed in getting a judgement, I will not be able to pay the £1500 as I am still without work. My wife pays all the bills at home - mortgage, food, council tax, the lot, bless her. She has a good job, but can they take her income into account as she already supports me?

  16. How come companies can get a ccj with impunity, and ordinary folk get nailed?

  19. I was being a bit thick and just assumed it was for an M&S credit card. As you can see from the date, it was back in 2001. I had a lot going on at the time so it sort of blended in with all my other 'interested parties' who think I'm such a splendid chap that they like to keep in touch as it were.... I will ask them for the rest of the t&c's though, just for the sport. Thanks for your interest, Nomore B.

  21. I've already sent them that letter, so perhaps they have sent the wrong standard letter back to me. Thats what happens when the boss is out of the office seeing if anyone from the House of Lords is up for a bit of extra pocketmoney!
  22. In the first box, top left, it states that ...'upon the terms and conditions set out overleaf and in the personal loan schedule which together constitute this agreement.' On that basis it does not comply with my cca request as they have not provided me with a full copy of the agreement. So I guess I should write back and tell them that they havn't complied and am therefore putting the account into diispute. Any one advise. Incidentally, has anyone taken on M&S on an agreement such as this and come out on top? Thanks Nomore B
  23. I sent the CCA request unsigned and got my wife to sign a cheque from our joint account for £1. Just wondered if there should be other stuff on there to make it enforceable.
