Yep, I had one off them, wrote to them saying that I can't believe they were writing to me when I have proof of a letter I sent them over four years ago with credit card details on accepting the low settlement figure they were offering..... then they send me a letter 21 days later telling me that they are now in a position to bankrupt me..... so I write to them again enclosing ALL the original paperwork.... Not heard from them since and this was over 5 months ago now! I wish I'd known about the go to court and get set aside thing as I would have gone for costs without fail!
  5. I'd say the 2006 regulations come into play, as it was opened online, I think you've deemed acceptance of the T&C's when clicking the "accept" button. Still, CCA them, but I think that's what they'll come back with.
  6. It'll never happen. Ultimately, we're all responsible for our own actions. That includes running up debts with credit cards etc etc etc... We do not have to have credit! There's that little thing called saving for things too

  12. Yep, Monday to Friday worker. Contractual holiday is 25 days plus bank holidays, but I left on the tuesday after Easter, so they are already accounted for.
  13. right, i wasn't given the opportunity (I left at the end of March 2008 due back end March 2009!) Should I point this out that I wasn't given the opportunity to take the leave? What I'm really angling for is my 5 weeks holiday plus the 6 bank holidays on top of my leave so I get more time off!

  15. So go back to the police station, give them the details and tell them you need the crime reference number for a matter going through the courts currently. Write to them, and enclose a copy of the letter with your application to set the SD aside.
  16. Hmm.. DirectGov says... "You can add holiday to the beginning or end of your leave. You may not be able to carry over untaken holiday entitlement if your maternity leave goes over two holiday years, so it's often best to take this at the beginning of your leave." But I didn't have this opportunity... .....! which is where the difficulty lies!
  17. It's on an account basis, they would just re-credit the account - no actual money changes hands! This from another website which, although I admit the English isn't perfect, puts it quite succinctly! "I think he meant the company is not allowed to refuse to supply an item legitimately advertised at a price, as this constitutes advertising fraud.   18. My company's holiday year runs from April 1st to March 31st each year and we get 25 days holiday each year. My maternity leave started on 18th March 2008 and is due to end on 18th March 2009. It is company policy that holiday cannot be carried over. I wish to take my full statutory maternity pay. Can I ask for my complete holiday entitlement to be added on to the end of my maternity leave as otherwise I have no other way of taking the holiday, or I have to lose it (unless they offer to pay me for it - but I'd rather take it!) My thoughts are, if I have to take the full leave before the end of March 2009, then I have had to end my maternity leave early and it is my statutory right to be able to take those 52 weeks, which they are then surely overriding by making me "take the holiday or lose it"! What are peoples thoughts? Do I have the right to ask to take the leave even though it falls into the new holiday year?

  21. well yes, what was the judgment actually for?? (edit, I see, loss of bargain..) I have a feeling that they will appeal it when they get your paperwork to be honest...
