I just saw an ad on facebook for that "ratiomoney" so had a look! They seem to have websites set up for ALL the information you can get for FREE on this site. Wouldn't surprise me if they are members and charging people for information they are getting from posts on here!!!!

Well it's a bit difficult to see "humour" when you've quoted what some would say is a reasonable source, now if you'd made up a source, that might have got people realising it was supposed to be funny

Aye, from reading posts on here, mobile phone contracts aren't providing credit so the terms of the CCA regarding enforceability aren't applicable! (please someone correct me if I'm wrong...!)

What a great idea, organise a CAG pressure group - forum access by approval only (and minimum of 50 posts on the forums or something to eliminate the DCA registering, just to get access) This is where email/letter campaigns could be devised to highlight some of the awful practices of these firms!

what happens though if the PO hands over the package WITHOUT asking for ID! My local sorting office used to do this, must admit last time I had to collect something delivered to me by Amazon, they did ask though, so maybe they're getting hotter on this now. HOWEVER, they asked to see ID BEFORE they went to collect the parcel, not once they had it!

go to the office and tell them you have a parcel waiting, but ask to SEE it BEFORE you sign for it. If you don't want it then, just refuse it. They send SD mail back after a week if it hasn't been collected.

if you read the posts in this forum, you'll find all the answers to your questions and more (From the fact that you've been able to come straight here and set up polls, post in nice fonts etc, I'm guessing you are no stranger to forums or computing)

The first advice I'll give you is READ READ READ this forum to gather as much information from different posts. You'll be amazed at how much you can learn from it I think I spend half my day on this forum refreshing to keep learning. Once you've got a bit of knowledge, be assured you won't wake up dreading the day again, you'll start to even look forward to the post arriving Lastly, NEVER talk to these people on the phone. If they ring, tell them that you wish to only communicate with them in writing from now on. There is a letter you can send indicating this in the templates library I believe

But do be reasonable, there really ARE only a few people on here who have the in-depth knowledge with a lot of these issues. A lot of us are still very very new here and we just read read read to get as much information as we can to help us. We all get frustrated and want personal attention, but at the moment, there just isn't the help around ... but if we all read and learn as much as we can, from the information given here then there are more of us to help in the future. My motto on this site is "pay it forward" and if we all did that on this site, then the help will appear in abundance and no one needs to feel left out again

I always believe that if you have the slip to say that the letter went recorded delivery (especially as they now actually check the address before they send it and it says "address verified -yes or no" on it, then that is proof enough that YOU have done your part in sending it! Remember, as Moorcroft say, the fact that you have sent it, even if not read by them, is enough -

I think I'm in love.. all these books you keep referencing that I want to go and find :lol: However, as for Professor Goode, "The leading text on this area is Professor Goode's Consumer Credit: Law and Practice which spans more than five loose leaf folders which means an answer can be difficult to find. Right, but in real terms, there wasn't any money that passed hands was it? I'm assuming it was to buy on credit and pay off? Still, please do keep me updated, I'm interested in how it goes -

Tis irrelevant I'm afraid and there have been countless of arguments over many forums over this. When you click "place order" you signify that you accept their terms and conditions - one of which is "contract is formed on dispatch". They state that there are occasional mispricings. This is quite obviously a misprice and I'm guessing that Littlewoods will be able to back that up with printed copy. The whole reason the "on dispatch" was put into the T&C's was because of the wonderful world of online mispricings You have to have four elements to have a valid contract - offer, acceptance, intention to create legal relations and consideration. They will argue that as the goods had not been dispatched the offer you made had not been accepted. I think you may find you will just lose more money by filing a claim than gaining to be honest. -

Most online stores these days state the contract is formed "when the goods are dispatched to you" and not before - to avoid these sort of mispricings. -
I wonder if that book will now make it into the top sales lists at Amazon with us all rushing to go have a look at it (I think they're now published under the "city law school" banner though as none seem to have been published under the above publisher since the end of 2006).

You see, once you KNOW your rights it becomes a whole different ball game doesn't it I told you you would find you won't be afraid of anything anymore (and what did I say about looking forward to those letters arriving... I bet you'll be checking the post every day now! )

I believe that the 30 days is not relevant at all anymore since the new Act? I think it's automatically default after 12 days and the removal of the criminal offence. -

An update : As we're all very quick to come down on the DCA's I feel it's only fair when we recognise when we get it wrong too Well, the upshot is, I did my own sums today from bank payments and their letters, and discovered that there are no charges applied to the account despite two threatograms detailing them!! so we can remove 1/1000000th of a black mark from their name (now now fuzzybobble, stay calm about the removal of the black mark, it wasn't their fault this time )

That's most likely Phoenix s.a.r.l then. Don't worry about the post anymore, get those CCA's off and relax until such time as they send you something back. Of course the ideal is when they tell you there is no agreement... I keep those letters VERY VERY safe - they are worth a few thousand pounds in a couple of cases I love waiting for the post these days, and get so disappointed when I don't have any letters :grin: I think there are a few on this site who feel the same. Once you actually KNOW your rights it becomes a whole different ball game
