  2. Yup, there are some great people on this site It's just as well they do stay after they've had their problems too, or else there would be no one here to help others when they come on with problems
  3. But the fact that you have sent something recorded still gives that record that you have sent something to them should it be needed at a later state! (Remember the Moorcroft paragraph "this letter serves that requirement, even if not actually read by you" )

  6. well if you S.A.R them you have to send £10, then they have to send all the details relating to your account I think. So see which way is the cheapest and go that route maybe?
  7. The only thing with the irresponsible lending thing is I think a Judge will just say to you "why didn't you send the card back if you didn't ask for it" ? Not what you want to hear I appreciate, but you should be prepared for it!

How can they say "a method for halting legal proceedings" You are asserting your right at LAW - this was precisely why these laws were created to stop this type of cretin!! Should we all just roll over and say "I'll pay whatever you want me to pay whether it's legal or not" Reading that letter has made me really angry! Remind them that the fact you don't have your CCA IS enough of a defence already without having to add to it! :mad: . . .
  10. You say you sent a cheque two years ago, so why not send them proof that the cheque was cashed - a bank statement for example? The bank can send you a copy of the cheque if necessary too! Surely that solves all the problems in one go?

  12. Don't online contracts come under the new regulations though, so if you tick the "I accept" button, that is deemed as good as a signature? (as you have the 7 day distance selling regs to cool off and cancel afterwards and all that...)... ?

  15. I think they may be saying take it to the court, but do NOT send it to the DCA and do NOT let anyone from the DCA/Halifax/Court take a copy of it. Give them the reasons that it seems DCA's have been telling people they need to have a signature before processing documents and it has been alleged that they are using these signatures to cut and paste onto documents before they send! OF course if I'm wrong someone will correct me
  16. How did you respond to the county court claim? (you have to file a response on the forms they send you ... did you do that?)
  17. One thing I notice when coming into this forum is the amount of "stickies" at the top of the page. They're almost taking over the first page of the forum. It seems 3 of them are all related to Cabot 3 of them are related to stopping telephone calls I just wonder if they could be merged / others reviewed and maybe taken off perhaps due to taking up so much of the page? Of course I may be way out of line in mentioning this, and apologies if so
  18. I'd send them a copy of the letter of cancellation and ask why they are still harrassing you. Send it by recorded delivery. The phone being stolen is irrelevant I'm afraid.
  19. oh, and some people draft what they want to say, post it here then get one of the site team to go over it before they take it to court, to maximise the chances of a positive outcome.
  20. You have 18 days from when it arrived I believe. How did it arrive to you by the way? In the post, served personally? was it second class post?
  21. Where to send the forms should be on the SD you've received? If it says "your local court" - ring your local county court (use the courts website to find that) and they will let you know the nearest one you can go to. Print off the forms, fill them in, take them to the court you have found as your "local court", they will then take them off you and stamp them for you then you wait to hear further.
