  1. I agree and I have sent those letters, but there's a limit to how many more DCA's and Sols I'll send the same letter to. Best wishes in your fight - I'll be watching this thread with interest.
  2. I'm probably not the best person to advise, (hopefully someone more clued up can post here?) but personally I would contact the FOS by phone explaining to them "the ICO recommended I call you to report HSBC for failing to fulfill my SAR" and take it from there.

  5. Hi emma, the problem I have is keeping them on the phone long enough to get any meaningful answers out of them. Furthest I've got is, "Did you get my letter?" to which I've had several negatives and one answered me with a question. Yes, it's Barclays (the client) for two accounts being chased by 4 DCA's and two Solicitors so far. I did get one CCA reply but it was just a page of conditions with a letter stating the account is so old (pre-1985), that's all we need to supply. I wrote back telling, that just won't do!
  6. Why not ask the FOS as advised? (Makes me laugh that the ICO will ask HSBC to ensure they follow the law.)
  7. Hi emma, I've got Apex sending me love letters/calls etc. Can you please explain how you got them to admit everything over the phone? I can't get any sense out of them. Good luck.

  9. Hi bazaar I've been very frugal in my letter sending so far. For Alleged Debt1 First letter was a CCA req to RMA followed by the In Dispute Bemused letter to NCO. I've also recieved demands from two solicitors and another DCA (Apex). For Alleged debt 2 I've sent CCA req to Calder to which Barclays responded with a get out clause Pre1985 letter earning Barclays a Now in Default Letter. I best start saving my pennies then, at £1 a stamp I'll probably also have to cough up for a couple of SARS and what's a CPR31 gonna cost me? I'm off to research what a CPR31 is now...

  11. Personally, I'd be more interesting in having the offenders arrested for burglary, trespass, illegal eviction or whatever is appropriate plus theft and/or criminal damage to property and belongings.
  12. Thanks for letting us know you've secured a new home for now, albeit imperfect one and it's good to know you finally get to sleep at nights! That's dreadful behaviour from someone. Has anyone admitted the eviction saga?
  13. They just don't see the irony! I'm not advising you do this (as I'm just a layman), but my thoughts are, your dispute is clear and simple enough isn't it; "Prove you have a legal right to claim"? You might turn the tables on them and ask them to make a fully particularised and substantive claim. Oh wait, you have done, a CCA request
  14. Hi bazaar, This is where it gets confusing as the CCA request went to RMA who were chasing it at the time. After sending my CCA request, NCO took over the chase so they got the "in dispute" letter. I've lost the plot to be honest with you, APEX are the latest to be chasing me up now. Today, I got another postcard (in an envelope) from Calder Financial and a phone call from Apex who I told shouldn't be calling - he retorted he's just doing as requested by their client (Barclays) and gave me the impression they'll continue to harass me even though I told them not to call. They know there's nothing we can do to stop it and that's what's bothering me most.
  15. No agreement yet. One replied to - quoting pre-1985 rules, the other CCA request hasn't been replied to at all.
  16. Oh, ha bloody ha! I'm surprised it takes a learned judge and all those Lords, Lady's and Viscounts to decide threatening letters coming from a computer are to be treated as coming from an individual. "The primary responsibility should rest upon local public authorities which possess the means and the statutory powers to bring alleged harassers, however impersonal and powerful, before the local justices" But the quote above leaves me flabbergasted. Yes, it shouldn't get to the courts, there's plenty of law and regulation to stop harrassment from even propagating but no-one willing to enforce it.
  17. I'd be very interested in this approach. Can you give me more details of how, what it costs, details needed to be presented and burden of proof etc?
  18. Indeed, I've just read "Ofcom does not investigate individual consumer complaints and we will not respond to you about your individual complaint. However, we monitor all consumer issues and may investigate a company if monitoring data reveals a particular problem. You can help us by filling in our consumer monitoring survey form." I've fired off an email to my phone company (Pipex) for now and registered my number with the TPS, as advised per ofcom. Further reading doesn't bode well though. They say they put regulations in place in 2006 and will review them in 6 months but nothing about any reviews which are now up to two years old. No charges or PPI's, just usualy interest. I got another letter today from APEX
  19. Are ofcom effective? Their advice seems wooly and ineffective. Seems I need to make lots of complaints with no promise of action or justice. "Ofcom speaks to phone companies regularly. They give us information about silent calls which we can then use to begin investigating the worst offenders" All throughout their site, it seems there have been rules and regulations in place for many years - designed to stop such nuisances - which tells me they are an impotent body.
  20. Spoke too soon! I got a call from Calder yesterday and she was an ignorant cow. I told her she's not supposed to call and she insisted the "we can, we're allowed bit" so when I told her that I won't answer their security questions she said "Right, then we'll take action against you" and hung up! I went out later and returned to a silent answpherphone message from the same number. I don't know why, but that has got up my nose and I want to punish them for it. Now here's a new one! I got a call today from a recording that began "Hi, have you got debts for more than once company.....blah blah blah, please press 6 to speak to a live operatore" so I did, intending to ask how they got my number but it went dead?!!! 1471 has no number so I can't call back to complain. As well as calls to me, I'm also getting calls for previous tenannts and I'm mightily sick of them all now because I'm powerless to change that. What bothers me the most is when I'm working on something and have to put it all down to answer the phone. I'm really cheesed off.
  21. I did take meter readings but over time I've mislaid them so cannot verify the bills at this moment. When I can, I will apply for any refund due, you can count on that. Regards DD, they are refusing to set up a new customer account until at least 50% of the arrears are paid (a policy I fear was put in place to force low-income customers onto the very expensive pre-paid meters) so I'll play their game for now and get the debt cleared. I actually like the DD system as you can reclaim any money's paid although it's not without it's faults I agree.
