Tragic case of Judgement because a cut up card was produced by MBNA at hearing.
MrMT replied to alfwithhair's topic in MBNA
RIP Terry and my condolences to his family and you Alf. Such sad news and I can't help wondering how much of his demise might be attributed to the despicable treatment he received from these callous inhumans and the mistaken judgement held against him. Shame on them! -
"Sorry, you can not give reputation to this post" - can anyone tell me why not? Thanks very much for this as I was just asking how I can get to experience such cases before I'm hauled up myself. Sorry I can't add to your rep for some reason. p.s. Anyone else get the impression the Barclays rep was just hired cannon fodder? Seems she was treated with as much contempt by Barclays as they do their debtors by the sounds of it.

I can't even tell lies consistently but I might be able to swing that one. Cheers Kraken1.

"Calling" doesn't mean visiting.

Hi Kuno, if you get another doorstep caller, they should leave as soon as you ask them to. If not, you can call the police for trespass. I'm sorry you were distressed by that caller but as you realise, they can say what they like with impunity, and often do. It's always a con so refuse to even speak to them and certainly don't give any personal details, or reveal who you are. Best wishes.

Hi darcus, I've got several of the calling postcards from Calders and they let me down everytime! I'm desperate to meet a DCA face to face and they just won't keep their threats. Did you get a response to the failure to supply correct CCA letter?
-
Mine started with RMA, then NCO, then Westminsters, then SC Leatham Lock, then Apex. I'm sure there's another I can't recall right now and expect there may be some more.

It's good to see something is being done and handy to know the circumstances which the OFT takes a dim view of; I'm of poor health, low income, no job and have no assets, for instance. However, I think it's wholly inadequate that they rely on complaints - how can the mentally ill complain for instance?
-
As much as I feel they deserve it, I'd strongly advise against blowing a whistle down the phone as I suspect it can be a criminal offence - something like premeditated GBH? Sorry to put a damper on your plans but I'd hate to see them suing you for personal injury for instance. Far better to entice them to your home (I've got what I owe you here, come and get it) and then deliver their prize.

Hi Kraken, I'll heed your advice and ask the court manager/clerk for further advice. As I say, my interest is for my own possible pending case (or maybe two) otherwise I am just being (respectfully) nosey - perhaps in a journalistic way, saying I'm from CAG? I doubt I could pass myself off as being intelligent enough to be a law student and my age will certainly cause suspicion under that guise.

Is it possible to find CCA cases at my local court and would I be allowed to be present? I fear I may have to be a defendant one day and would like to get a feel for the process as well as picking up pertinent facts and arguments used in such cases.

I don't understand how they can admit it's legally unenforceable and in the next paragraph claim they are legally entitled to continue to collect??

So in his "fantasy", you'll be waiting naked for him with a wad of cash, right? Sounds like sexual harassment to me!

Baarclaycard standard letter when CCA'd
MrMT replied to Duffychick's topic in Debt Collection Agencies
Enron, that's given me a thought. Once I've established the call is from a DCA I could begin saying "First I have to ensure you're aware of my rights and your responsibilities - and then recite your letters from the OFT without interruption - bet they hang up before I've finished, if they can't interrupt me -
Advice please: calders offer of settlement
MrMT replied to helpfordad's topic in Debt Collection Agencies
My first contact with Calder was a reduced offer of final settlement too. Makes you wonder why when they claim they're entitled to 100%, doesn't it? Treat phone calls with the contempt they deserve - don't talk to them on the phone. Insist everything is in writing because they are prone to conning and [causing problems] you without a paper trail. Smell a rat, learn more from this site, get your rights in perspective then you'll feel more in control. -
