  2. Has anyone else noticed that NatWest are advertising their "SALE" of mortgages and loans on TV? I daren't look into what that means in reality but in retail, it usually means the seller considers your statutory (consumer) rights are null and void, no returns are accepted etc etc.
  3. alfwithhair Yes, I think you're right and I misheard the 9 for a 5. The reference number I thought I heard also ends in the same ref number in the letter so it must have been a call from Barclays/RMA/NCO/SL! noomill060 This wasn't a silent call. A message was left although I have had one or two silent calls before now. I'm dubious about reporting them to OFCOM as I don't believe they will/can stop such calls from what I've read on here? I hope I'm mistaken and willing to be proved wrong of course. No, there's been no reply to my CCA request which was deliverd on the 2nd Dec. The account isn't statute barred AFAIK, but it is now in dispute. Disconnecting the phone isn't an option either unfortunately and IMO is letting them get one up on me. Yes, I do want to fight back but I need potent weapons, not the toothless wonders set up to pretend they're pro-consumer. I consider the CCA request a potent weapon and am now considering sending a SAR to Barclays as there's some discrepancy over how much is owed. i.e. There are two outstanding debts of which this is one (and the largest owed). I have some paperwork showing it goes back to at least 1994 so I'm now hoping their records are somewhat incomplete. If so, could I get them written off? Worst case scenario is they win a court battle and I'm ordered to carry on where I left off (paying them £10pm).
  4. I had a message left on my answerphone this morning but hard to hear it clearly. It was addressed to my name, said he was from "inferion" or something ryhming with that, gave a telephone number (0870 503 0957) and reference number. His number was witheld. How can I stop these nuisances, they are causing me to get anxious every time the phone rings now. Without contrary advice I sent the Account in Dispute letter to SC Leatham by recorded delivery today. Is that sufficient?
  5. I failed to print and send that last letter, thinking I could ignore it until after Christmas, silly me! I'll get it printed after this post and send it recorded tomorrow if I'm not advised otherwise due to the following. On 21st I received this letter... (sorry for the poor quality) Today, I also got this.... Does this make any difference to the above letter (post #27) I should have sent earlier?

  7. I am starting to get silent calls now. I was woken by one this morning but failed to note the number calling. I'm disabled and don't need my sleep interrupted so not happy about them calling early (to me).
  8. A big congratulations to that customer but it still riles me that the banks can miss a legitimate payment without penalties! ie. If their customers missed paying them because of an "administrative error" there's an automatic k-ching LATE PAYMENT CHARGE APPLIED but this bank seem to think it's a legitimate excuse! Double standards? Yes, the government think it's good for the economy to screw the public so allow these one-sided rules.
  9. Tomorrow will be 12+2 working days since RMA got my CCA request. If I don't get a reply tomorrow, what should be my next steps please?
  10. I am sick to death of the letters that come through my door with large bold print on the outside stating "Immediate Action Required" and TVLicensing on the back. After almost two years of this, I moved home only to find the same letters arriving to "The Legal Occupier". One day I bought a vacuum cleaner from an electrical store and shortly afterwards I get another TVLicensing letter addressed to me by name, claiming the electrical store have informed them I recently bought a TV, etc etc. Maybe a month later I get a knock at the door (and rather embarassingly, I let rip once he'd done his thing) - he was rubbernecking round the door and then he said, I can see you don't have a TV (I do actually, it's a portable 3" that I never use) I'll put you down for a year so you won't get any more letters for a while. Well, I still get the letters addressed to the Legal Occupier and I would dearly love to know how to stop them for good. I refuse to waste any more of my time and money telling these people. What can I do? Can you imagine the police stopping pedestrians to ask if they have a car license because a lot of people drive cars???? Who do they think they are?????
  11. To recap, I was originally contacted by RMA and subsequently sent a CCA request which has been delivered and was signed for on 2/12 to which I've had no reply. However, the day I sent the request, RMA have stopped contacting me and NCO have taken up the cause. Do I need to re-send my CCA (but this time address it to NCO)? I ask because I've just taken a call from NCO and they tell me there's no letter recorded on their system.

  13. Caldwell and RMA drove me here though I'd previously joined this site due to a Bank (A&L) issue and forgot I'd joined! Notice the Poll is showing a massive landslide victory to the "other" category I'm suprised RMA and NCO are not listed.
  14. I have checked the PO website and it claims my CCA request was delivered 3/12/08 so the clock is ticking. Today, I get a letter dated 2/12 from NCO telling me that I have ignored RMA's request to settle this voluntarily (erm, I didn't, I just refused to engage in telephone conversations, they refused to communicate in writing other than ask I call a telehpone number). It goes on to say my account has now been placed with us (NCO) for the collection of the full amount. Then they go on to say that, although full amount is required, they are prepared to take full consideration of my circumstances and may be able to agree a realistic payment plan to avoid further action. Once again, they're asking I call an 0870 number and ask for (named person). I've told them everytime I won't deal with this on the phone so why ask me to call? One thing that bothers me about "for security reasons/data protection act" rubbish over the phone - lots of people know my name, address and date of birth so how does citing those details "prove" to them who I am on the phone?
  15. Don't take this as advice, but I'd be inclined to respond by saying something like, "You're correct to assume I may consider applying to the courts to have this matter resolved. I can assure you that all the evidence I will be relying on is the very letters you have been sending me so far - I trust you kept copies yourself?"
  16. Well the very day I posted the CCA request to RMA I get a call only it's now from NCO! I know NCO own RMA but does this mean I've wasted my time and money sending the CCA request to RMA?

I require you to supply the following documentation before I will correspond further on this matter. 1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) - your obligation also extends to providing a statement of account. I enclose a £1 postal order in payment of the statutory fee, PO Serial Number 1027730886. 2. A signed true copy of the deed of assignment of the above referenced agreement that you allege exists. 3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not under S189 of the CCA 1974. Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities. As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the CCA and therefore is a complete defence to any court claim that is issued. Take note at this stage, that any legal action you may contemplate will be both vigorously defended and contested. MrMT

  20. Ok, so one says a name, other says the company, so who's right? - eeny meeny...... But I've read a lot of people have shot off CCA's but the response rate is virtually 0% so you're all obviously addressing them wrongly. Just on more question (for today), is there visibility of when/who cashes the P.O.?
  21. Due to unforeseen circumstances, I've not been home for a while and left it all hanging. While Calder have only sent one card, RMA have been very busy calling me (auto message to call them if answerphone takes it) despite me telling them in no uncertain terms not to. I have yet to send the CCA's which is why I'm back now. I have the address but who do I send them to? Should it be a person or a position, like the data controller for instance? Ditto for the postal order and should it be crossed?

  23. The letter's from Southern Electric. I'm now wondering if I was just talking to a script monkey that didn't want the hassle of thinking for himself so will try calling them again.
  24. Typical of me to get matters confused, I assume it makes no difference who they are really? I don't know who owns the debt as I'd always dealt direct with Barclays until these letters were delivered, they could be [problematic] for all I know but will send CCA requests to them.
