Update... Letter sent re the cancelling of Direct Debit also letter re bank charges and other information held on their files. Yesterday I received 17 envelopes each containing one month's statements so I can obviously expect a whole rainforest to descend on me before they get the whole 6 years delivered. Plus one extremely large envelope containing a 2 page generic reply assuming that it was just the charges I was requesting and they were legally obliged to advise me that because of the court case they wouldnt be processing any claims at the moment. -

This is what I am trying to establish ? Have they breached a code of conduct here?. My access to the HSBC online banking has been cancelled so I am not able to cancel the Direct Debit from there. Castlebest, I am attaching a copy of the DD guarantee. The last bullet point says that the DD can be cancelled at any time !!. I have received one of these from each company I have set up a DD for over the last 2 years or more. ie, Telephone/electricity/council tax/TV Licence etc. We have offered reduced payments on a monthly basis for the loan, however HSBC are quite adamant that the overdraft incurred by bouncing the DD is to be funded with these payments. This of course is a vicious circle with the OD increasing as is the loan with extra interest and late payment fees also being added. -

OH has a loan with HSBC bank and a direct debit was set up. This is the only item left in the account as a parachute account has been set up. When he got into difficulties he asked the bank to cancel the direct debit which they refused to do thereby applying for the loan payment twice a month which incurrs bank charges both for unauthorised overdraft, bounced debits etc. I have in front of me a 'Direct Debit Guaranteee'. It says: This guarantee is offered by all Banks and Building Societies that take part in the Direct Debit Scheme. The efficiency and security of the scheme is monitored and protected by your own Bank or Building Society. If the amounts to be paid or the payment dates chanbe, HSBC bank plc will notify you three working days in advance of yoru account being debited or as otherwise agreed. If an error is made by HSBC Bank plc or your Bank or Building Society, you are guaranteed a full and immediate refund from your branch of the amount paid. You can cancel a Direct Debit at any time by writing to your Bank or Building Society, please also send a copy of your letter to us. Now I have written to them asking this be cancelled and they are refusing to do so...Although they have also rejected a prorata offer for the loan, we are still sending it and HSBC are using the funds to reduce the overdraft. Can they do this ? are they in breach of their own code ?. -

I have now received all the paperwork from CCCS for a joint debt management plan. However, to keep creditors at bay, I had CCAd/SARd everyone. As only 3 have replied with the correct paperwork, should I contact CCCS and advise them that I want to delay going on the DMP until such times as these companies have come up with the information I have requested ? Should I even mention to CCCS that I am pursuing these companies to prove the enforceability of the debts ?. -

Good morning slick132. Thank you for your reply. Sorry, about the wrong forum. Could you please tell me how to get it moved over. The reason I am sending by Special delivery is that so many of the Recorded Delivery letters dont seem to be signed for. I hve been checking the RM website for one particular letter sent 2 weeks ago and it doesnt even appear to have been delivered. Many thanks for the link .

I have sent both CCA and SAR letters to Bank of Scotland. They still have a week or so before they breach the SAR. However in the post today I received a letter dated 4th February. It terminates the account and states that within the next 48 hours the account will be referred to a Debt Recovery Agent. It is becoming very frustrating that letters are taking so long to be delivered. Especially as I am paying out £4.30 a letter to ensure swift delivery and signature. I notice that this was a 2nd class mailing as well. Should I write again enclosing copies of the letters already sent.. pointing out that they are in breach by referring to a DCA or just wait for the DCA to write and send them a letter telling them they are aiding and abbetting a crime. Thanks xx

Go to citizens Advice as reallymadwoman suggests above. They could also confirm your signature. Creditors have no legal right to your NI number or bank account numbers. Perhaps a letter saying that only a court can demand what they are requesting and then continue to pay them what you have been doing and let them get on with it. That Verity Billson is a PITA -
I have today received from MBNA new T&Cs masquerading as 'Helping you to manage your credit card account easier'. Does the following make any real difference to enforceability: 15f - If we cannot enforce any conditions under this agreement, it will not affect any of the other conditions in this agreement. If we cannot enforce any paragraph, condition or part of a paragraph under this agreement, it will not affect any of the other paragraphs, conditions or the other part of the paragraph or condition in this agreement. we have clarified the wording relating to enforceability of this agreement. I have read through the form and can find nowhere it clarifies the wording as above ? I would have scanned it in, but the print is so tiny that I dont think it would be very clear.

Sorry, I have only just found my thread again ! DH is 'dear' No it was a joint account in the broadest of terms. Although I have never written a cheque, used the debit card, or had a DD in my name. On the odd occasion I needed to telephone the branch, they wouldnt speak to me. Probably thought I didnt exist !! I guess this will teach me to take more interest in what is going on financially. I suppose in a way I have had a result from the letter sent inasmuch as with regards the loan HSBC now write to OH however they are still pressing both of us for the charges stacking up due to the twice monthly bouncing of the Direct Debit set up to pay the loan and of course interest charges on the overdraft. Sigh... !!

Have sent off the letter to request PPI is cancelled. I am now preparing a S.A.R. letter using the templates on the forum. I have noticed from the bank statements that the £1.00 token payments sent over the last 3 months have been used to pay off the overdraft caused by the twice monthly bouncing of the loan. Should I include a note to say that as the SAR is a legal request , to use the £10.00 fee enclosed with it would be a misappropriation of funds ? -

Is it possible that there is a hiccup in the system, it does happen sometimes. Although the cynic in me says, perhaps you should telephone them and find out for sure or send them a letter/email . -

I will be sending a letter to HSBC tomorrow requesting they cancel the policy in that they mis sold on the 2 counts as shown above. If anyone reads this, could you please advise if I should S.A.R. HSBC as well. Many thanks x -
