Mindzai - thanks for your advice, and the moneyclaim was sent on 19th(Issued 20th) Haven't done anything about the letter from SC&M as yet cos I've been quite poorly for the last couple of weeks (presume some obscure virus) so I've had to share the short bursts of enthusiasm to do anything between various tasks. I am absolutely certain that this tactic is a deliberate attempt by Abbey to throw a whole box of spanners in the works. If it pays some money back without notice, The payment may not be noticed (not everyone scrutinises their statements) and any further claim can be complicated as a result It might just placate you enough to cease your action It could claim a bank error and withdraw the money in the future (thus plunging you into more problems) How you deal with it depends on your attitude. Hi Lee. Next step is to send the preliminary request letter from the letter templates library. Click on this link for the letter...... Just copy and paste into word, edit the bank details and send it off. If you don't have Word, Wordpad works as well, just set it up to suit your printer. When you send your request letter,n send your schedule (list) of payments being reclaimed. The easiest way to do this is to use a spreadsheet to list all your charges. Welcome haasturner. Before you start please have a thorough read of the FAQs (there's a Step by Step guide here too). You should print these out to refer to so as to avoid having to ask basic questions later. Then look at other threads in your bank's forum, so as you know what you can expect to happen You need to spend 2 or 3 days gradually getting your head round everything. There's a lot to take in, but it's time well spent and will ensure that you succeed in your claim without problems This is a self-help forum and you must be prepared to put in time and effort. Moneyclaim it is!!! They have made it clear they will not be refunding however some people would advise to wait 14 days from LBA but I personally dont see the point because your not going to get another letter and its certainly not going to offer u ur money back! Hope this helps Clark xx:p0 points

Good. Now add it up and claim the interest as well.If this is a credit card,claim back the contractual compounded interest rate.It's on your statements. eg.. 1.567% X 12 which equals..18.8% APR... The contractual rate is what they charged you,so it works both ways. Hope this helps Ukaviator0 points

Hi Trudi Can you post the reply of their defense here?.It may help others if a mistake has been made.Don't worry too much about the court.The judges are sympathetic towards people when it is their first time even setting foot in the door.You will probably be paid out before then anyway,as full disclosure of true costs will be presented.They definately don't want that out in the open. What idid they mean by Vague?.. If you go to the GUIDANCE NOTES on this site,everything you need besides your costs breakdowns and statements, is all there to help you.Don't forget the Mcnamara audio interview as well.It will come in handy. Thanks again zoot ... you are good! Probably quicker if I can convince them to keep account open and accessible, but if it requires an injunction then so be it! My card might not work but I may be able to access online and transfer to other account until new card arrives. Will have a look tomorrow as bed is calling me now! Firstly, I would like to thank all of the Moderators, Higher account holders and of course Dave for setting up this wonderful site!. People who give up there valualble?? valuable time to help others deserve to be rewarded in Heaven or at least shown a good time in Hell!!. This is the start of my claim against HSBC. I already had all of my statements (filed by my ever efficient wife!) and have totalled the charges on my 2 main accounts to £3759. I have written by initial request letter for the charges back and will deliver that by hand to my local branch on Monday morning with the beakdown included. Within that letter, I have also incl0 points

its not good when they file a defense but this is what they do, its rare that natwest pay before this point. It just means they are showing to defend the claim. They have so far always paid out before the court date.0 points
