    • Hiya,    Thanks for getting back to me! I’ve always ignored, however my only concern now is starting a new job and them emailing my new employer, as they have with previous employers. Is there a way to make sure they don’t do this apart from hiding LinkedIn?    As people mention, it’s worth telling each bank direct my address, should I tell the credit chasers that I’m dealing with the bank direct also?    Thanks,

    • Thank you Man in the Middle, Everyone I know this may not make a difference but is it worth mentioning the fact i did believe i sent everything correctly but with all going on with my mother at the did not realise that stamp was not valid? Also the SJNP notes say they sent a reminder i did definitely receive this if i did it would have prompted me to realise something was wrong and rectified. I have to fill the form in online today so any more advice is gratefully received. The area is Gwent in South Wales it states on the form if i plead not guilty then send me the date of the trial Sorry as i've stated previously totally new to this and thank you for you assistance  i know you cannot say for certain but realistically by pleading the above what would be the most likely outcome be ? is it still likely to be 3 points and £100 fine ? or am i likely to receive higher and more fees?

Nick Wallis has made an interesting observation in his blog yesterday or today that yesterday's witness, Alwen Lyons, implied that forensic accountants Second Sight weren't doing a good job on their investigation of SPMs' complaints about Horizon. Nick's theory is that not being good at a job seems to be telling the Post Office things it doesn't want to hear. And that having been told things they didn't want to hear about the Horizon system, that training was terrible and their investigators and prosecuters weren't good enough, they decided the solution was to sack Second Sight and buy more expensive advice in the hopes of getting an answer they liked.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi , this outfit are threatening court action over a debt with Capital finance one , in a nutshell cap finance one would not accept a repayment plan so handed it over to silvermans . my question is do I need to send them a CPR 31.16 request ?

 

for reference the original loan of £250 now according to silvermans is £725 , cap finance one have added " fines " and charges for letters not recieved .

 

Just need to know what letter to send prior to court action , I have kept every correspondence with silvermans and have not spoken to them

No, you can't do a CPR request as they won't have the information, and this should be in the Payday loan forum....

 

Daniels Silverman are 'solicitors for rent' and can easily be fended off, I have had considerable experience at doing defences for PDL companies. Basically the company cannot add interest and charges ad infinitum, they cannot add 'file referral fees' or other fees.

 

All you owe Capital Finance One is £250 plus the one months interest (if you haven't already included it). Daniels Silverman are on a sticky wicket.

 

You MUST send their letter to the following organisations, explaining you are trying to come to an arrangement but all CF1 want to do is add charges and fees

ww.consumerdirect.gov.uk (for the OFT)

http://www.ripofftipoff.co.uk (the newish Trading Standards site to report dodgy firms - which CF1 and DS would seem to fit.

Hi Silly girl , thanks for the information , I will photo copy the letter and send to the relevants you have told me about . For reference I have already told silvermans that the account is in dispute and that i have tried to come to an arrangement with CF1 on numerous occasions , I have also told them that I will only be paying the original loan plus 1 months interest .

 

Interesting fact I recieved an email from CF1 saying that they have a new website that you can quote " make a payment , make a part payment or make a payment arrangement "

 

I replied to the email asking them to clarify the point about making a payment arrangement , I got no reply . So i reng them without giving them my name and said I was making a general enquiry regarding an email that they sent , I asked if they accepted payment arrangements , the girl answered with we dont accept payment plans , is a payment plan the same as a payment arrangement ?

I told her that the email states you accept payment arrangements so is this correct , got the same answer we dont acccept payment plans

 

I am building up quite a dossier of information between CF1 and Silvermans

 

anyway so for now I assume you suggest that I ignore the threat of court
