      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello all! new here!

 

Right.. paid some money (well my wife did) into my bank account last week for sum of x. Checked online account and found that the amount credited had been withdrawn and amended to a lower amount minus £20.

 

I queried this with the bank and after 4 working days, an obnoxious woman phoned me and told me I had made a mistake.

 

I asked how can I make a mistake? when the lady at the counter confirmed how much I was depositing and credited my account with the same value?

 

No answer.

 

I asked when did this correction take place? advises at the close of business... I advised that I am 100% adamant that the sum of x was paid in and how can a bank correct this entry after the deposit has been completed? no answer was given and she asked if I had a reciept... never got one so she said there is nothing they can do...

 

I asked them to check CCTV footage to confirm this but shes not interested.

 

Surely this is wrong?

 

Any help would be appreciated.

CCTV would only prove you went to the branch, not what was transacted. However, why would you have not taken a receipt (they are usually offered if you don;t have a counterfoil to stamp? Faced with it's their word or mine, they will always win - hence the need to get receipts and KEEP them, until the credit has been successfully applied. Paying in by cash is always risky, as there is no other way to prove what you paid.

Surely the fact that it has been paid in, withdrawn and then another amount paid in is suspicious in itself, have you asked how the withdrawn amount was taken out - if the bank account is in your name and the withdrawal transaction was not made by you then something definately seems amiss.

can you clarify - did you use paying in book or just hand your card over the counter?

 

If no receipt given why was that - it is normally automatic.

 

If it was at the close of business and the cashier was out by £20 to prove which transaction it was they would have had to check all the days transactions against records.

 

If it clearly shows on your account money in and then an adjustment they should have contacted you anyway to let you know why .

 

I would complain in writing with a copy of print out of your account and ask for proof of the error.

Which bank was it?

 

LTSB don't offer receipts any more unless you use your paying in book. Apparently you can check online to see that the correct amount has been credited! I did query it and they said that they could recover any paying-in slip to prove the amount!!!

 

If you are paying in for someone else, you can ask for a receipt but they don't advertise that.

This happened to my dads business account a few months back. He's with Barclays. I did the banking for him and I paid in money on two seperate slips, and also cashed a wages cheque.

 

When the account statement came in a few weeks later, I noticed an adjustment of £10 made to the money I paid in. I telephoned barclays and was told that the cashier had made a mistake and mis-counted the takings, which meant that she supposedly gave me, with the wages that I withdrew, an extra tenner.

 

My first thought was, surely if I had an extra £10 with the cash I withdrew, then I would have most definately spotted it when I was dividing the wages between employees pay packets.

 

Anyway, Barclays refunded it. I made a fuss about them not having any evidence, and that they just took the money without firstly asking permission or advising us at least. I know its only a tenner, but its principle.

 

You've gotta watch um. They think cos its in their bank its their money, but its NOT, its ours and they're supposed to be taking care of it. Gone are the days when banks really did look after your money and not just swipe it all the time.....

This is a strange one.

money goes missing.

no receipt.

telephonists who couldnt care less.

good grief, what bank is this ?

If you have an on-line account, what does that state happened.

Does your partner know any of the staff who can verify what she payed in.

and for a future note. if you pay cash in and dont get a receipt, go straight to the hole in the wall, and you should be able to get a mini-statement.

Now, I will not name and shame the bank in question but Natwest (damn..) have just sent me a letter.

 

To answer some questions, yes the money was paid in on my account, later withdrawn and then credited with the lower amount.

 

The letter makes no mention of this but to confirm that a deposit of x amount was made.... even though I have already queried why x amount was withdrawn but to no answer.

 

I will be replying to thier letter! so watch this space...

You might like to mention this from the Banking Code 2005

 

Article 10.2

 

If you do not recognise a card transaction which appears on your statement, we will give you more details if you ask us. In some cases, we will need you to give us confirmation or evidence that you have not authorised a transaction.

 

I'd be asking how the withdrawal was authorised (PIN or Signature) and where's their proof. It's your bank who should have a copy of a withdrawal slip.
