Sort of.

 

They went to court to try and defend against the bank obtaining a set-aside.

 

It's completely different to taking the bank to court to reclaim the charges.

. Those two cases and others were only hearings which occurred at the instigation of the bank in order to have default judgments set aside.

There was one case involving NatWest which was lost nearly 2 years ago. There was another case in Scotland involving Robertxc against the nationwide which was won at the issues were slightly different but it did revolve around bank charges and most importantly the court ordered his default to be removed from the record.

But in terms of ordinary cases where users have claimed penalty charges -- not a single one has ever yet gone to court.

This doesn't mean it won't happen -- and you should be prepared for it.
