    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi had a letter from Halifax:mad: the account number they initially gave me when i phoned at the beginning of this is wrong, they gave me the account number of my new account and i didn't realise as i have not used it yet:roll: my sar i sent on the 29/06/07 do i have to re send it and start again ? i had forms ready to send to information commissioner it has been over 40 days waiting i asked for this account number but they would,t give it to me on the phone:mad: so i am going in to bank tomorrow to ask i have already sent cheque also i,m really mad now

Its their fault youve not got yur proper ones.

 

Why not give them a ring and explain what has gone wrong.

 

Tell them you want it rectifying as youve already paid the mandatory fee

 

Cant do much harm

How about amending the http://www.consumeractiongroup.co.uk/forum/bank-templates-library/6986-data-protection-act-non.html puTting in how you understand an error ocurred in the past (employees are human after all) but you feel it is fair if you allow 14 days before proceeding to the courts. Last time I wrote to Halifax I gave them 28 days. They have responded saying they will comply within 40 - but at least I got a response and their attention. You have my sympathy however. HOW FRUSTRATING!!!!!!!!!!

Did you actually go into the bank to ask for the number and did you have I.D. on you .

 

What reason have they given you for not passing you the account number.

 

If youve not sent complaint to ICO yet then I would certainly think about sending it now.

Thay are blatently holding personal information to which you are entitled and I cant see how they can justify doing this.

No wonder your mad , I'd be blo**y purple with rage by now. :o

hi everyone:) i sent my complaint to information commissioner a few weeks ago ,what happens next, haven't received any correspondence from anyone no statements or account number:evil: what will the information commissioner do?? should i be doing something else ???

thanks:pforgot to say halifax told me that they do not hold any data over 6 yrs?? liars:roll:

what will the information commissioner do??

Not a lot as they are months behind with complaints at the moment due to the number of SARs that the banks haven't complied with.

Hello

 

I complained to the Info Comm on my Mint claim.

 

Did you file your complaint on-line?

 

I think it took about two weeks before I received and email acknowledgement, then they wrote to Mint and gave them 6 weeks to reply, which they finally did.

 

So all in all it probably took a couple of months to complete

Forgot to say, if you raise a court claim for non compliance you should get some compensation as well (normally somewhere between £100 and £300 depending on how much hassle you have been through).
