      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi people.. I have an opinion that i want to share with you that i hope can ease your fears.

Through my work, i recently went to Nat Wests offices in Borehamwood where i believe most claims start off from.

The equipment that i needed access to was actually located in the room set up to deal with our claims (they didnt know i was claiming or they would have left me on the doorstep.

Being like a kid in a chocolate factory, i couldnt get enough of what was happening.. Heres what i saw. !!!!!!!!!!!!!!!!!!!!!

 

The room was located to the side of the main offices and was staffed by 5 very lovely people who are human just like you and i.

In the centre of the room was a table approx two thirds the size of a snooker table. on the table were piles and piles of claims.

Stacked up against 2 walls were boxes and boxes of claims being processed.

Heres the bit i want to share with you.................

At this stage you are absolutely nothing more than a name and number on a piece of paper. They dont care if you are Bill or Ben or any Tom, Dick, or Harry, (no offence) You go in pile number ONE.

Eventually you get moved through pile 2, 3, and so on.

My conclusions were that allthough they are trying their hardest to resolve the cases, they are simply snowed under.

I am not making any excuses for any bank, and these are my own conclusions, sometimes claims just dont get dealt with as quicly as we would like.

What i would suggest, if i may, is that allthough this is a very personel matter to each individual, You, or i are just number XYZ 123 ABC or whatever they choose to label us with.....

As you can tell im never gonna make a fortune writing books, but the best piece of advise i can suggest is, dont take the battle personally, and follow the steps giving on CAG word for word. Day for day. If it works for thousands of others it will work for you and i as well, but you MUST MUST MUST push it through. Dont delay another day Good Luck.

My heart bleeds for them. :-D

 

Of course, they could spend some of their billions in profits to get more staff in top process those claims faster. Or they could just pay them out at 1st letter so the piles get down faster. :rolleyes:

Or if they hadn' unlawfully taken the charges in the first place everyone would be happy.:)

I agree with all of you...If If If... but they are not going to, and nobody except the courts will make them...So as i said my point was, dont waste a single day delaying...Do it now, or if you have started and the time is up to move on to the next stage, do that now as well..

Fascinating to hear layout of THE office. I agree with the point that they do have the resources to process claims qiucker if they want to.

I know staff are human but sometimes I cannot help but think like this :-

They say its all in the Terms & Conditions

Sometimes this does sound like "I am only obeying orders"

Where have we heard this before ?

 

Er well perhaps I should say that it will have been my Dad that heard that phrase not me, I am a surprisingly young fellow.

It's a numbers game.

 

The longer they draw out the process the more likely it is that some people will withdraw.

 

There is no profit for the bank in refunding charges. The process is simply a conveyor belt on which the persistent will get paid. They don't want to make it easy but they seem to have accepted that they will refund everyone.

 

We also always need to remember that the banks are still profiting from these charges and those profits still far exceed refunds.

Hello people......

 

Got an offer today from NatWest, no confidentiality clauses, no shut up or else, just a very nice, very sorry, blah, blah, blah, but it is me who is wrong..Yeah, yeah, yeah, letter.

 

Anyway, my claim is for £ 1,334.00p plus £ 185.21p interest plus £ 120 court fee.. Total £ 1,639.21p...

 

The offer is for £ 1,334.00 as full and final on this claim.....

 

As i am/was, a very new PC user, and have made a couple of mistakes in my claim, i think i am going to accept the offer as i dont fancy the DJ rejecting my claim because of this....

 

Will post all lit details later when i get 5 minutes..

Yes i know i should, but right now i feel this is right for me. Dont let my decision influence anybody elses though. I feel there is a pattern to all of this, and im damned sure the banks know that they can save tens of £k if they pursue this line of offer...

I have 2x Barclays = £3k, at defence filed stage, and just about to start 2x Barclaycard = £2k, so this will be £1,214.00p more in the bank this time next week than i have now.:p :p :p

Its not about the cash, but thank you anyway, its because i am pc useless and made mistakes in my claim that i feel could go against me at a later stage. I even claimed for 2 x £35 "credits" on my account that i thought were charges...

Promise you wont tell NatWest if i dont :rolleyes:

I received Cobbetts defence today 05/07/07.

12 days after Natwests offer, and 2 days after i have been paid...

 

Suppose they had to do it because of the time scales..Not a whimper from Barclays as yet ????? filed 2 claims on sameday as NatWest...

Congratulations, nice one mate. Did you reply to the cobbetts letter? I have recieved mine and am a bit confused by the legal jargon, of course they wish to defend and want to request further information, what do i send?
