Hi,

 

Apparently you can claim on line rather than having to take papers to the courts - is it better or detrimetal to do it this way - I just know 4 me would be much easier - pls advise :)

Hi, Ive just sat down to begin court proceedings myself, Ive decided to do it on-line. Did you send a spread sheet in with dates of all your charges ? They seem to advise doing it on this site, I only sent the full amount, and now wonder if it will be a problem. I cant believe how nerve racking I am finding this !

Well, you don't want to incur any more charges, now do you?

 

HBOSplc told me today that the claim would be updated by themselves!!!

Charges:£5,156.39 Information Commissioner's Office informed June 12th who wrote to BoS, June 22nd for non-compliance. #1a/c: passed to BoS Senior Review Team. Discovered 2 further a/cs, and 3 Loan accounts. "Goodwill offer" of £7,424.23 06/07/07. Accepted (partial repayment). 20/07/07 Top-up payments of £2,558.10 & £1,154.00

£11,136.33 paid back thus far.

New claim issued: 9/07/2007 for 3rd account: £500+ PRESSING ON!

What I meant was ...... Don't pay by cheque - or you'll get a charge slapped on you!

 

And, HBoS told me that although when I submitted my claim for repayment (WAY BACK!) it stood at £X,XXX. They would take into account the fact that the interest was still accruing (as at 26th June - or 2morrow - 27th June or 10 days' time.)

 

Therefore the FINAL claim would be the original £X,XXX + £Y,YYY interest from the date I submitted the claim.

If they have offered the full amount you've claimed then you have to accept.

 

They aren't going to admit liability - the whole reason they never end up in court is that they don't want to acknowledge that their charges are unlawful.

still waiting for the cheque untill then im think of holding off writing the courts to they have offerd me full amount and till ive got the cheque in my hand

If so, how long did it take to receive from the moment you sent your MCOL / N1?

 

Also, did they mention anything about closing your account?
