Hi All

I started my claim to get my money back form the Alliance & Leicester. I got all my statements worked out how much they owed me and then sent in my claim. The bank then sent me a note and a cheque for much less then I was cleaiming for. I then returned there cheque and filed a claim with the online court. now the bank is going to defend there case and I sore this on the court web site...

The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly....

 

 

 

Now I have been waiting for over two months now for a court date now and don't know what to do now. :-x:-x all I am after is my money back.

as far as I know this is quite normal at the moment you will get a date from a local court.

 

out of interest - read some of the threads on Lloyds about the importance of turning up - and the fact that there have been different wordings about attendances for preliminary hearings or directions - where in fact the cases have been settled.

 

It seems that it varies from area to area how long you will have to wait now.

Hi jansus

 

Thanks for your post I'll will have a look at the Lloyds posts . If I do get a court date I will turn up wareing a suit the one thing that get's me about A&L is that when I open the account I could not have a overdraft on this account which was Ok because if I did not have any money in the account nothing would come out and I did not get charded. But now I still can't have a overdraft but if I get a DD or standing order and I do not have any money in the account I get charged for it but the DD or standing order dose not get paid and that just PI** me off. A&L cake & have springs to mind.

Look at posts by Jburchell - one under general and the others I think under Abbey (My head is spinning after looking at so many threads)

 

Or put in guilford as a search and lots of interesting threads about the "bulk hearing" there.

 

I Am going to proceed and then when it gets close to the court date try and ring and settle - seems to work for some so worth a try

 

Also encouraging that on Friday some people (on lloyds thread) were awarded wasted time costs. Especially where in one case the bank had settled the day before but not even told the claimant!

Well after sending them a e-mail to find out when I will get a court date I received this.

And I am not a happy bunny about how this has turned out as I could have missed my court date because

I have not received any court paper work read on.

this

claim was transferred on 1st June 2007.

what was their excuse for you not receiving this ? As far as I have seen this is always sent in writing - and then you should get a letter from your local court as well?

 

Unless they are so inundated they forgot to send you the letter?

 

Presumably this is just the transfer date you still have to get a local court date- which could be weeks away

hi pabrahamas,

 

I think when they say the claim was transferred on 1st june,

it simply means they transferred it from the Northampton Court.

I don't think it means you have missed your court hearing.

Why don't you ring the telephone number they gave you in the email tomorrow morning, and ask for Lee, and ask him which Court it was transferred to, ask for the relevant Court's telephone number and give them a ring - to see if a date has been set aside to hear your claim.

or - you could simply email him back if its more convenient - requesting the same information.

OK update

 

I have today received my court date for the 17 July 2007 at 10:00 AM :Dwhich look odd as the court opens at 10:00AM and having a look at the order I will not be the only one there taking A & L to court:confused: on that day. Now I have my court date what do I need to do next?

Well what I got is a preliminary hearing where several others have raise the same or similar issues and involve the same defendant. So I am not going to be on my own on that day in court. Do you think that A & L will settel now that I have a court date?

difficult to tell at the moment as there has not been a settlement since April/ May time I dont think. But lots of cases coming up in bulk 29th June and 4th July are two dates I know of.

 

Its worth keep reading other bank threads as well - not to get frightened but there are lots of useful link backs in some of the threads on LLoyds and in General - about the importance of attending and being prepared.

 

Sometimes people have gone thinking it is a preliminary or directional hearing and it has been settled- other times it is just to decide on the next step or how long the actual case will take.Some banks are settling the day before - or on the doorstep - in which case some courts have awarded costs to the claimant on the day:D

OK

I had a look at this as I got my court date...

But I have some troulbe as my bank account came with a cheque book & visa electron card but no overdraft but I can't find the T & C's for this type off account. I did not get any charges when I started this account but as the years have gone on they started charging me for going overdrawn but not offering me the option of have a overdraft as the bank said I can't have a overdraft with this type of account and if I wanted one I would have to change it over to a full current account but they would not do that. But as I have said before I can't find out what type of account this is ans it is not a full current one or a basic one as I got a cheque book here is the link.

apparently I have read on "stressed mother v A&L " that they have just settled a case a day or so before hearing ( not on this web site ) so that is encouraging

Hi All I received this e-mail from Wragge & Co. and they are going to pay up -interest but + my court costs. So I would say to you all JUST STAY IN THERE:D and when you get a court date just phone or e-mail them and ask them if they would like to settle out of court and you don't know they may just do that read on...

 

Our client is prepared to offer, without any admission of liability, the sum of £2,425.60 in full and final settlement of your claim. Should you wish to accept this offer, please reply to us and we will arrange for a transfer to be made directly to your bank account.

 

To stressed mum don't be so sterssed out as you have not done anything wrong all you are doing is getting your money back just hang in there and you will get your money back and that go's for every one here.

OK if you have has a bank waste your time by not bothering even to attend court to argue their defence then have a look at this...

I've read this, as I'm sure many others have. Great idea (especially if you've got a co-operative judge:rolleyes:). It's about time it was made a lot easier for the claimant to win by asking the banks to produce evidence of appearing in court/winning, etc.icon7.gif
