    • Hi I assume the Loft Conversion with the eaves and crawl space was there when you initially purchased the property. Even in done after purchasing the property and the correct permissions were in place i.e. Local Authority, Land Registry, Freeholder which is Southern Land which would be required as a Leasehold property. The difficulty is if the Loft Conversion was there when you purchased the property and there is no evidence in your documents of the eaves and crawl space due to where the Red Lines stop in the plans or even after purchase it was added this is the reason you are having issues with selling due to those missing Red Lines in the Plans and any other Buyers competent Solicitor would flag this up. I can understand the reasons the Buyer wishes a Deed of Variation probably there Solicitor requesting this to ensure those missing red lines are covered before the Sale as they Flagged this as an issue as Red Lines missing on Plans and want buyer protected. As for the £8000 costs Together and cohort Southern Land are trying to charge have you thought of contacting a few Property Solicitors yourself to get a few quotes. (only mention this because when I research this possible costs can range from £500 - £2000 depending on the Deed of Variation work required and nothing to stop you doing this then approaching Together and cohorts with it) Also ask Together/Southern Land for a breakdown of the £8000 costs for the Deed of Variation. Yup do send both Together and Southern Land a Subject Access Request (SAR) requesting 'ALL DATA' that simple phrase covers whatever format they hold that data in whether it be emails, written, recorded calls etc. They then have 30 Calendar Days to respond and that time limit only starts once they acknowledge receipt of your SAR Request. When you purchased the property some 17yrs ago are the Solicitors that you went through at that time still operating?     • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi to all I am a newcomer who has been busy reading all the different cases - esp Wizzkid and Jonesfamily etc.. I sent my Data Protection Act with £10.00 cheque on 11th May and like other people I have received the statements for the last 13 months and alone this has added up to over £3000. Like everyone else these charges were out of control and a knock on effect and has left us with some debts. I have opened another bank account and am in the process of transfering dd's etc... We do have our Mortage with Abbey as well but are tied in until march next year, can they demand I close this as well ? has anyone else come accross this, we have not defaulted on our Mortage. I know my claim with be for more than 7 grand and I am very nervous but after reading other peoples cases I feel really confident that we can claim our money back that has been (edit) from us! A massive thank you for this site its a life saver.

Hi yes when I have the final figures I will be sure to let you know what I do, mind you I probably will be looking for advice as it won't be a small claims court if its over £5000 will it?

No it will be fast tracked but if we can both work out a way to split the claim without them getting wind of 2 claims or asking for a second to be struck out we can claim the lot...going to be tough but I'm sure there will be some sharp minds on the forum that will help out.

Hi yes once I get the rest of my statements then I can add it all up and go from there. do you know of anyone else on the forum that has claimed more than £5000 and been sucessfull, as you say there are some sharp minds here to give advice.

i'm fairly new here so no i don't. however the course of action I'm hoping for is that Abbey default on the DPA request by not supplying sufficient detail so I can submit a claim for £4999 plus interest then claim the rest in a second claim once the statements appear. Other than that the only other option I can think of is to split the actual charges ie £4999 for unpaid DD's then whatevers left for the remainder..

 

Bearing in mind I have one account that incurred around £300 per month for over 6 months and eventually ended up closed due to the fact that charges nearly overtook my wages and i have just received this months statement stating £350 of charges it doesn't take too many months of that to get over the 5K mark If I look at an average of £150 per month for 6 years that alone = £10800 if you double that for 2 accounts its well over 20K.....realistically I think my claim is more around the 10k mark

 

the maths thing makes me think that a lot of claims could potentially be over 5K as that would only equate to just £70 per month over a 6 year period. If you think about it one DD for insufficient funds = £30 and an additional charge for being overdrawn because of that charge of £20 would mean £3600 alone...the knock on effect usually means a spiraling of charges which would easily take you over the £70 per month minimum.

One way to split a claim is starting from 6 years ago is to add all the charges until they reach £5000ish and make a claim for that. When, and only when, that claim is settled do you claim for the next period. That way the bank cannot ask for claims to be merged, plus on the 2nd claim the bank will know you mean business

Hi no I have not received them yet but I did call Abbey yesterday and they said that I shold get these in the next 5 days! Have you read Seminole thread? as his/her claim is for approx 11 grand and is going to fast track it so I have been logging on to that to see what happens. Are you thinking of fast track or still splitting the claim. Also how long did it take you to get your statements?

Not got any statements yet had a microfiche letter or letters see the thread for details. I'll keep an eye on Seminoles case but fast track scares me a bit. I'm looking to split and submit multiple claims, it may take longer but its a tried and tested method.

No I just received the microfiche letter on Friday sent a reply back to that reminding them they only had 29 days left to comply so I've got about a month to go before I get that far. This week I'm going to tot up all the charges from the statements I have and see how much that comes to...there may be enough there alone to claim £5000 already as my wife tends to keep a couple of years worth of paper work and the majority of the charges have been over the last two years.

well got home to find the wife had found 22 statements from 2 accounts with Abbey..(6 years statements x 2 accounts = 144 statements). Added all the charges on these statements and low and behold...£4587 of charges...maybe i should just ask for this back based on the evidence I have then once i get the remaining statements from my DPA go for another claim... would be quicker.

Came home yesterday to find a bit fat wad of statements well badly photocopied microfish statements! mind you I am still short of 10 months! and I know they were my worst ever months, gave them a call and they assured me they were on the way. I will have to split these claims in 2 as it comes to just over 7 grand and I know with the other statements there is at least another 1500 there. Am sending off today my first letter asking for £4995 back, including the spreadsheet. wish me luck ....

got the standard letter today saying - sorry you had to complain bla bla bla - we will invesitage bla bla and will contact you in 4 weeks!! well still going to stick to my time scale so will send the LBA letter on 27th July !

hi - can anyone give me some advice - I am in a bit of a panic as - I am sending my LBA off tomorrow then 14 days will be up on the 10th august so then I can file the moneyclaim - but I am off on holiday on the 13th august till 27th August, should I wait till I get back off holiday to file the moneyclaim or should it be ok to do this before I go away - I am just worried just incase I have correspondance to deal with during the 2 weeks I am away.. or am I just worrying for no reason or should I wait till I get back off holiday to file the moneyclaim? or will I mess up my chances if I leave it? can anyone advise the best thing to do here - thanks
