    • Thanks, I've had my fill of this lot. What makes me so mad is that I had to take out student loan to get any DHSS help. And then when I tried to help myself and family they presented obstacles. Might be worth passing story to RIP off Britain?
    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.

    • no they never allow the age related get out, erudio are masters at faking supposed 'arrears' fees which were levied before said date and thus null its write off. 1000's of threads here on them!! scammers untied that lot. i can almost guarantee they'll state it's not SB'd too re above, but just ignore them once sent. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Right I drive a company van (plain white astra van) it's mine no one else drives it ever and I dont ever have passengers (well not yet anyway).

 

Apparently because of the new legislation I have to stick a sign up on the windscreen that this is a no smoking vehicle etc etc. Now I dont smoke anyway but I dont want to stick a sticker on my windscreen taking up more valuable screen space, I have a hard enough time seeing as it is because its a van and no one else makes allowances for you when trying to get out of spaces.

 

So is the employer right? I have to stick another sticker to the window saying smoke free, seems crazy to me I already have to have Tax disc and breakdown thingy on there.

 

They're also trying to tell the people that use their own cars and take the lease vehicles (which we have to contribute to about £100 per month) that you cant smoke whilst at work ie driving between sites seems stupid trying to tell people they cant smoke in their own cars

 

PS This is a local authority employer ;)

I believe the requirement is under Health & Safety rules which the employer must abide by. I'm not sure id a similar complaint about sticking the tax disc on the windscreen would be any more relevant. It can be placed anywhere it can be seen by the driver/passenger. Incidentally, the police won't arrest you if you've a cigarette in hand, but if stopped at traffic lights or parked, you might get done by Trading Standards.

The tax disc is tiny and in bottom left of the screen (on most peoples cars) by necessity the sign for no smoking is bigger and obviously has to go above tax disc/recovery info there's nowhere else for it, maybe I can get away with sticking it to the rear windscreen lol.

 

By necessity the sign is bigger than a tax disc because it has to have certain writing on it hence the concern.

 

I might ditch it and go back to using my car and claim mileage instead, mind you the next thing they'll expect signs in your car too, ffs.

 

I dont smoke anyway so there wont be any chance of them "doing me" hehehe

Under the Scottish rules, the size of the sign wasn't mandated - but using your own car and claiming mileage seems a pretty drastic alternative cos you don't like a sticker! Do what everyone else does.... swear blind it was there yesterday....

No it wouldnt be the only reason just the final straw kinda thing, the other thing was changing the excess from £50 to £500 :(

 

Besides 40p per mile I could make a nice little tidy sum :D

 

I guess I could try getting away with sticking it to the dash under where the tax disc lives too.

 

Thanks for the replies, theyre providing the signs and said they are the ones they want used to make sure theyre covered.

 

I think its funny that people that are using lease vehicles and paying and people using their own cars get penalised too, I hate smoking and cant wait till 1st July but some of these rules are just getting a bit silly

If you and only ever you use the vehicle then it does not need to have a sign. But most large employers will insist all vehicles have the signs displayed. It’s hardly the end of the world though is it?

No its not the end of the world (although it could be if you had an accident because of the sign concerned - joke!) but thats not the point the signs they want to use are largish and I dont want anymore of the screen taken up by anything especially as visibility is already really really poor because of having no rear windows to look out of.

 

I'll just lob it on the dash with some blu-tak and see if that shuts em up instead of fixing to the glass - compromise.

 

Irks me as well as I dont smoke anyway

Having been a fleet manager for Network Rail, one of my jobs was to put the no-smoking stickers in the vehicles.

 

The stickers were attached to the dashboard - anywhere there was space. There is no legal size definition.

 

It still didn't stop staff smoking in the vehicles though.

They should have an automatic fist that comes down from the roof of the car.

 

But only when it detects cigarette smoke. Could be adapted for a mobile tune to.
