      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

can i just ask, did you get the 8% interest with your amount from the bank? my amount had gone up loads with the interest since i first filed

So glad that you won against the nightmare bank

 

I think mine will go the same way as yours, I recieved a defence and 50% offer on the same day, have finally recieved my AQ this weekend as the local court had a backlog, so took 12 days between recieving defence and AQ.

 

I am going to pop down to court tomorrow to hand in as I am exempt from fees and the deadline is 18th December. I am noticing that the bank is holding out on alot of cases recently. I just hope they pay up on mine, especially as I am trying to claim damages due to default on my account which totally consisted of charges over my overdraft. I am also asking for default to be removed.

I rang cobbetts the other day to check they had recieved my rejection letter and she said were waiting to hear from bank about next step??

Hi Guys,

 

I'm new here, and I'm both blown away by it all as well as seemingly finding myself in this preverbial Minefield of information. Some simple layman advice would be much appreciated.

 

I heard about this site on LBC today, and have decided to try and claim back some of the MANY charges my bank have financially Bludgoened me with over the years. I have been with Natwest for atleast 20yrs, so it's about time I got SOMETHING Back!

 

I have a few queries, one of which is how does one start to get the ball rolling? I am currently unemployed and also very skint, partly due to Natwest using some or ALL in most cases of my benefit, to help pay some of my overdraft, leaving me alot of the time with NOTHING! Then charging me more after this. They have stopped sending me mail eg Statements and letters, as they say that the items just keep coming back to them. Even when I ask them to please start sending them again. I don't try to email of phone me to let me know of this problem either. I have a loan with them too which is having problems with the insurance claim, as they say that I have not been res[ponding to thier letters, so they just closed the claim. Yep, they didn't try to call me to let me know of this problem either, as I didn't receive any of their letters either.

 

Do I need to go into the bank personally, to ask for my statements for the last 6 or 7 years is it? Or can I just do this over the phone, and how much should I pay for them? After that, what do I need to do next?

 

I'm sure you've heard the same story over and over, but your help in this matter will be MOST appreciated.

The best place to get help is to start your own thread, like Chedder did, then a moderator or some other helpful soul will see it and hopefully be able to help you.

Also read through the threads to see if anyone has had similar experiances to you, which may help.

Hi Marcia what you need to do is work out what needs to be done. Start by spending some time reading thru the self help material starting with the FAQs link in my sig. Then when you are sure you know whats what start your own thread in this forum and inform us of your progress.

 

You only claim 8% when you file a claim at court but you will know all this after reading the FAQs etc.. Good luck :)

:D hi,cheddar what a journey,i,m about to follow the same path great to see you won.

nw gave me so many charges for my business i had to fold, nw transfered the charges to a loan then charged me interest on the loan,i had to sell my house ,lost my partner for six mouths due to the distress,and i ended up in hospital.We,ve since rebuilt are lives and got married so getting our money back would be the icing on the cake, for us.

Wow you've certainly gone through it!

Sounds like things are back on track.

 

The best thing to do is start your own thread, that way people we see it as a new claim and come to help.

Read through the threads as there is a lot of help in them and keep your thread up to date so everyone knows what help you need, what you've done etc. It also helps others.

I'm sure that if any bank had actually successfully defended a claim in court then they'd all be doing it and none of them would be paying up. If they did win a case then it was probably an exceptional situation.

 

If its in the small claims track then you're not liable for any of their costs, but you should read the FAQ and lots of other threads and they'll tell you the risks (however small - if you do things properly) that there are. Anyway, start your own thread on the Natwest board and that will give people a central location to answer your queries therefore keeping the information together and making it more useful for others.

Vodka the claim that went to court was done via a barrister who wasn't at all interested in winning the claim and basically messed it all up from what i can remember.

 

It is in the small claims and I agree there is a lot of reading around to do so i am glad to see thats what youre doing. after that start your own thread in the natwest forum and keep us informed of your progress. thanks.

In response to my Data Protection Act 1998 Subject Access request

I have received the following reply from NWB.

 

On the same morning I received a package enclosing last 6 years statements and in a separate envelope the following letter.

 

"Thank you for requesting copy statements held by the Bank

 

Any information that is required to abe provided to you under Section 7 of the Data Protection Act will be forwarded to you at the above address as soon as possible.

 

In the meantime we acknowldge receipt of the payment for £10.00 in respect of the fee.

 

With reference to your request concerning any 'manual intervention' to the administrative charges debited, these charges have been processed in accordance with the terms and conditions of our current agreement with you as a result of the activity on your account. In the event that you breach the terms and conditions, we will take the appopriate action, contacting customers when appropriate, or handling customer enquiries regarding their account status. When a customer has raised a concern in relation to this process, the decision will be communicated to the customer and where appropriate noted on the account.

 

If you have any queries relating to this matter please do not hesitate to contact me at the telephone number shown above."

 

Should I just calculate the charges on the statements or will there be other information to follow?

Seems like they have just got crossed over, make sure there is 6 years statements and follow the step by step guide. Also please can you start your own thread, you have posted on mine which is in the success forum you need to have your own thread in the main Natwest forum.
