      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Actually, to be fair to her and the legal team, I dont think that it is their fault, i believe that it is the Abbey themselves and their total lack of professionalism and that they are really bad loosers lol

 

I need to go and lie down now as I have been nice about Inga lol

Lol, Inga definately has an australian accent. I did post a link a while back to her profile and it had a photo. I think this is her Garland Hawthorn Brahe - Personnel Sydney | Inga Kirkman

 

She said a cheque had been sent on the 28th June but she is cancelling that to make payment tomorrow. I wonder if we are forcast rain when she needs to go to my bank ;)

Congratulations - looks like your son will get his birthday treats soon! I've been following your case on this site and in the Manchester Evening News with great interest as I am with Abbey too.

 

They've had their 4 weeks and wrote saying it would be another 4 weeks but I intend to start court action as soon as I have the £120 available but I am off work with stress at the moment.

 

I've incurred another £400 in charges since I sent my list of charges to them and although I ran out of cheques last week my new cheque book has not yet arrived - I wonder why?

 

I was widowed 10 years ago and left financially very insecure. I went into my Abbey branch at the time and explained that on paper I could manage but in reality I might need some help in the future. They seemed very sympathetic at that time but I have incurred thousands of pounds of charges since then.

Hi Sam and thanks for the warm welcome. As soon as I commence the court action I'll start a thread because I know I will need support from the "Lurrrvly members" on this site.

 

My middle son is getting married in September so it would be great if Abbey released the money they have kindly been "saving up" for me by then, as it would make the special day even more special :o)

I cannot believe they they sent the cheque on 28th June. have you moved!! so where did they send it.

 

Was'nt the Bailiffs going back this week!! make sure that the payment when you do receive it also covers the Bailiffs fees as well as you do not want to be the looser.

 

They are really stringing this one out.

They sent it to my adress, they sent the Bailiff a copy, so i have to accept that they did send one, where it got delivered to is another matter, and why it was only issued in the 28 as they court ordered i was to recieve the funds by the 21st is an interesting admission they ignored the court order.

 

In respect to the Bailiff, he was going back this week, but he advised me to call the abbey (gave me a number for legal team) and to call him back to let him know the result. The upshot is i will get the money paid into a Barclays account tomorrow, and warrant is on hold..but not cancelled untill i inform them of either non payment tomorrow where it gets reinstated or cancelled whn the funds clear.

They would've done a mashup of the cheque/letter. Completely illegal but incredibly common for companies to do this sort of thing.

Have no idea what that means... just jumping in to be a bit cheeky and ask a question!!

 

When you did your bundle did you make copies of the court docs and abbeys defence and how many pages approx was each bundle? Worried I'm over copying and printing :confused:

My bundle was 100 pages long, and i printed 3 copies off. I did not include anything i recieved from the court in my bundle as the court and other party (abbey) already had those. Although i did take them to court with me on the day.

Thanks for that. So far about 60 pages without statements. Glad I didn't print them all after scanning.. printer has steam coming out!

 

Have watched your interviews . very impressive.. Even had my mates talking about it (they aren't even claiming) and they knew who you were.. How does it feel to be famous ;)

I think the Abbey would call it infamous, i have loved being a thorn in their side, and hopefully the Abbey will have given Ashurst a kick up the backside for letting it go so far and get negative media coverage for them, hopefully it will lead to more peeps claiming and them settling earlier.

 

I havent even seen todays interview yet :( i am waiting on Channel m sending me a copy , but that will be next week.

My Lord, your like a walking billboard for CAG!

 

Think I've been very restrained so far, no chasing them or initiating negotiations.. maybe a bit too relaxed but have CC on 21st with up to 60 other claimants so just gonna see what they do when they get bundle next week... I just hope they recycle the masses of paperwork they must get every week!
