I was so confused, as other links seem to suggest that a response was required at this stage, so thank you for clearing that up for me!

 

As yet, no word from Courts, so just sitting tight.

OK, received "Notice to Pay Fee" of £100, or face being liable for their costs. Was not aware I would need to pay additional, on top of £250 already paid, but on questioning with the Court they have confirmed this to be right. So off I will trot on the morrow to hand over cash.

 

Then this afternoon I received the following:

 

DISTRICT JUDGE ******* has considered the statements of case and allocation questionnaires filed and allocated the claim to the small claims track.

 

1. Claimant do within 21 days of the date of this Order, serve a Schedule setting out the amount of the individual charges, the dates they were applied to the account and the reasons given for such charges.

 

2. Allocation Questionnaires dispensed with.

 

3. The hearing of the claim will take place at 14:00 on the 15 August 2007 at ****** and should take no longer than 10 minutes.

 

In order to utilise judicial time more effectively this matter has been listed with a number of similar cases.

 

The order in which the cases will be heard is only determined on the day, taking into account various factors such as attendance and urgent matters which may take priority. Every effort is made to ensure that cases are dealt with on the day but in exceptional circumstances it may be necessary for a further date to be given.

 

The court must be informed immediately if the case is settled by agreement before the hearing date.

 

Date: 23 June 2007

 

 

So, does this now mean that I need to prepare my bundle....or do I just need to submit a detailed list of charges/dates/reasons, as stated in part 1?

At the moment all you have to do is get your list of charges (date, amount, reason, amount of interest) to the court and to the other side within 21 days.

 

You'll need your bundle for the August hearing date.

You just need a print-out of your spreadsheet with a simple letter along the lines of ("Please find enclosed the schedule of charges being claimed for")

hi nell.....

 

nope - your definately not incompetant behind the computer - it's just you really can't upload documents onto this website unless they're a link - so like all of us it's a long slog typing all the letters sent to you out in one of these little "Quick Reply" boxes.....

 

If you have Microsoft Office Document Imagining it’s very easy to “cut & paste” documents on to your post here –

 

  • click “Start,“
  • open “All Programs”
  • look for “Microsoft Office Tools”
  • place cursor over it and roll down to “Microsoft Office Document Imaging” – not “MOD Scanning” –
  • open MODI
  • put document to be scanned in scanner,
  • click on the scanner icon in the top left-hand of screen and choose option for scanning (black & white best for posting on here) –
  • once scanning finished, click on “Done” to save document or click “Continue” if you have more than one doc to copy –
  • When you have scanned all the docs you want, select the text you want to copy – either by “Crlr” + “A” key or opening “Edit” and selecting “Select All” or by keeping cursor down over text.
  • Copy text & paste either to a Word doc or straight to the text box on CAG. Best copy all to a Word doc then copy & paste to text box later.

Not as difficult as it looks I can assure you.

OK, paid my additional £100 fee at lunchtime and handed over my detailed Schedule of charges (as per point 1).

 

I took three copies, but was advised I would be responsible for sending a copy direct to the Defendant.

 

Do I post this to the RBS address on my original N1 claim OR do I send this to Cobbett's?

 

Any help would be a Godsend!

Most scanners come with some form of free OCR software, can you not use that?

 

Never explored it but I find using MODI quick and easier than the software supplied with my Epson scanner which is a bit of a guddle.

Getting really twitchy and just had a thought that has turned me cold.

 

I am convinced I read in the forums that you can include the maintenance charges that are lumped on to your account - this is normally listed as £34, broken down to £6 royalties fee (standard monthly) and £28 maintenance (if you have gone over your overdraft limit).

 

Am I right in thinking that this "maintenance" figure has been cloaked, as it is actually a penalty levvied only if you have gone over your limit, which the bank claims to be the cost of additonal administration on your account?

 

Gawd. Does anybody have the answer??!

I have not included the £6 Royalties fee or separate interest charges, but I have included the £28 maintenance fee. These have already been submitted on my initial claim and my response to the allocation to the small claims.

 

If this is wrong, what happens now? Does this mean that my claim will be struck out?

One more question...if Cobbetts offer to settle in full can I ask for further charges, that have accrued since submitting this claim to the present day, to be added to the settlement figure?
