      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Good stuff... at least thats one thing we have out of the way :)

 

Have you looked at the POC yet? I have no clue how to work out the charges per day :confused: or if we add overdraft interest :confused:

 

Oh I think it's too late for me to be thinking of all this... I will never sleep tonight my head is spinning.

 

Do you have any others to claim for after this one?

No, not got to that yet, probably check it out in morning. I've had a bit of a "Play" about with the interest calculator, & if I did it right its easy to work it out. Have a good nights sleep, & dream about what you want to buy with all that money you 're going to get back from haliprats.

This is the only claim I have with the bank, but I have a claim with Wescot, they say I owe them them money for goods bought from a catalogue, but I had already moved out of the address in question-but to make matters worse the person(s) who bought the stuff used my name. see link http://www.consumeractiongroup.co.uk/forum/debt-collectors-debt-collection/89242-westcot-its-my-name.html

Yes thanks money, how are you now, I just read your thread - good for you - you gave them exactly what they deserve. You're right, they should let each other know what's going on (you just can't get the staff these days he he:D:D).

I've not heard anything from them yet, & I've just checked my account online, & there's only a couple of ££ in there.

I can't give SS any more clicks, I keep getting told I have to share it out LOL.

I have got a letter from Wescot though, & basically they say that my name is clear with the credit reference people, & that I have no reason to worry about that. They also say that they now acknowledge that it was someone who nicked my name, but they can't find any of the paperwork belonging to the matter.

Ah well that's for me to sort out on monday. Had to take car to garage this morning, we think it needs a new clutch. Bl**dy good job it's my partner & not me who's paying for it repairing.

Yes it is the only money I get, because I live at my mum & dad's, & I don't have a place of my own any more, it seems that I aren't entitled to Income Support. I even have to pay for my prescriptions - so I have to buy prepayment certs - which add up to over £30 each month (4 items).

I loose out on lots of things because of this. lol

you could always try for remission you have to write your outgoings and incomings on the ex160 add it all up on both see whats left take it to court with evidence and they will tell you i am sure thats how it works

you can do it online im sure someone will put you right if im correct

My only income is Incapacity benefit and it isn't enough to live on (the law says) so it is topped up with Income Support, which only amounts to a couple of pounds, but it entitles me to free stuff. I did not know this until the CAB told me to claim for it!

 

I agree that not being on Income Support you loose out on lots of benefits that you would usually get.

Thanks for the info money, I have just been on the website & to say the least it is a very good way of finding out what I might be entitled to. It works out that I could actually be entitled to an extra £3.05 a week, which will make a heck of a difference for me; like free scripts. etc. Its very annoying when the jobcentre don't tell you what you are entitled to, I'll be going there as soon as I possibly can. Do you know whether I would be able to claim "back pay". It would be very nice if I could!!

Yes you can claim back pay... but be quick because there is a time limit.

 

It looks like you are in the same position as me as that's what I get :)

 

Let me find the link for you, as you can claim Income Support online, print it off and send it to your local DWP dept.
