Meanwhile, I really wonder whether the default date – as being the starting point of the six years – something which has been decided in law. It has always seemed to me to be extremely unfair. According to the limitation act, the six year period begins from the date on which the cause of action accrued. This normally means that the breach of contract occurred. Section 6 of the limitation act says that in terms of loans, the cause of action begins on the date that the debt was "demanded". Over the past two years this has come to mean the date that the default notice was issued – but I have to say I don't find that very satisfactory. If you received demands for payment before then then I don't see why section 6 shouldn't refer to that date. Did you not receive any correspondence at all in 2017/2018? What was the value of the original loan – and how much you pay off? I see that there was some kind of instalment agreement. Tell us about that. See what my colleague @dx100uk says but anyway, if I were you I would send off an SAR immediately both to the claimant and also to the original creditor. It costs you nothing. There is no downside. Get in the post straightaway with some kind of utility bill establishing your identity. You can even include a copy of the claim form as well as proof of your identity

I'm going to say that the photographs really don't say very much and once again it's a real shame that you didn't take lots of photographs of all the issues including the Windows and the state of the inside of the room. You can certainly bring a claim here if you want and we will help you but I'm really not sure of your chances of success. It sounds to me as if the manager you spoke to was dismissive and nothing was particularly agreed or admitted. If you want to bring a claim then I would start off by establishing a paper trail where you point out the things that were wrong and the fact that you discuss this with the duty manager who appeared to be dismissive. You could ask them then in general terms if they have any proposals to make. I think you're in weak position. I don't think you should start threatening them with legal action or anything at the moment and even if you did bring a legal action for the full amount I would probably advise you to negotiate a settlement of maybe 50% – if you're lucky – at mediation. Have you tried putting up Google reviews and reviews on trust pilot? This could also be a good way to start. I'm very sorry but when you deal with these kinds of issues then you need to collect evidence as quickly as possible. It is the first thing you always do when there is a poor hotel, a stone in your cornflakes or a motor accident. I'm afraid that you have to think this way and maybe it doesn't come naturally – but having run the consumer action group for 18 years, this is rather second nature. If you have any phone calls with them then you should read our customer services guide first and then confirm any admissions they might make in writing.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

£1.48/day is what I get with your figures, so I think it is right. You don't put the court fee in the total for the claim - there is a seperate box for that.

Question for you all.

 

I assume I have no problems claiming from more than one Natwest account?

 

Now I have got the ball rolling I am keen to claim from another current account I have had for years but not really used for sometime.

 

Should I just wait until this current claim is settled?

THey will, they will - but probably not just yet. It is almost certain that Cobbetts will say they are going to defend and they will put in a defence. You will probably have to go through the AQ/not AQ bit and may even get a court date. BUT they will make you an offer.

Is it worth preparing an AQ now? Will I need to do one?

 

Just want to stay one step ahead of them as I have two holidays coming up over the next few weeks so I am concerned I may not be here!

 

My N1 is stamped on the 15th so am I right in saying they have until :

 

29th June to acknowledge the claim (14 days)

 

then

 

15th July to file a claim (30 days)

 

As I am away on both these days how should I handle this?

The AQ is a fairly straight forward form. Have a look at http://www.consumeractiongroup.co.uk/forum/bank-templates-library/11644-allocation-questionnaires-guide-completion.html. It will be an N149 if your claim is Her Majesty's Courts Service - Home

 

Cobbetts (as you will know by now) always do everything on the last minute (or even later!). Whatever the court receives they inform you but that takes at least a week or more. If you get an AQ, you will have 2 weeks to complete it. (Cobbetts usually even exceed that timescale!)

 

If you are worried you might be away, ring the court and inform them. You will find them very helpful.

Actually recived my Notice of Issue from the Court this morning!

 

Your claim was issued on 15 June 2007.

The court sent it to the defendant by first class post on 14th June 2007 and it will be deemed served on 17 June 2007.

The defendant has until 02 July 2007 to reply.

 

By my calculations that means I should expect a defence by day 28 which would be 15th July 2007.

 

So I was a few days out with my dates! I guess I do not need to do anything until the 3rd July then to see if the file an acknowledgement!

 

Fingers crossed when I get back from holiday on the 16th July there is some good news!

 

What are Natwest generally doing at present? Are they waiting until last minute to file a defence then dragging it out for a slong as possible for a court date before making an offer?

 

Whats the general time period from filing a defence to an actual court date these days?

Ok. So i have just got back from a lovely weeks break in Italy to find an Acknowledgement of Service letter dated 28th June 2007 from Cobbetts.

 

This is my first letter from them. Do i need to do anything at this stage or just sit back and wait for the 15th July and see if they file a defence?

Hey all!

 

Just returned from my week away to recieve a defence from Cobbetts today!

 

In the same post I have recived the notice that a defence has been filed from the court and an Allocation Questionaire that I need to return by 30th July 2007.

 

A few questions :

 

The defence states ' A fee of £100.00 is payable by the claimant on filing of their Allocation Questionaire'. Is this something I have to pay at the court when I take it in? Can I get it back?

 

Is there anything special I need to look out for on the AQ or do I simply follow the instrustions on this site and take a copy of this and my schedule of charges in to the court?

 

Do I need to send a copy of my AQ and Schedule of Charges to Cobbetts at this point?

Guys. I am due to return my AQ by the 30th!

 

I think I have nearly completed it and will check it out aginst the posts on here first!

 

However as I need to pay another £100 to the court with the AQ should I still be going ahead follwoing yesterdays news that all claims are going to be put on hold?

 

Does anyone know anything about this? Am I likely not to get paid out now! Not good as I am £250 down in court fees!

Advice is to continue as normal with all claims, see here http://www.consumeractiongroup.co.uk/forum/natwest-bank/107585-oft-test-case-what.html so please do make sure that you meet any deadlines related to your claim.

 

Have a look through here for further guidance on completing the AQ. Also, you should consider asking for the defence to be struck out as an abuse of process and requesting the draft order for directions (although you've probably already done this!!!)

 

Best of luck - try not to worry too much about the OFT test case announcement at the moment. :)

I'd strongly advise you to do this as part of your AQ submission. Have a read through here http://www.consumeractiongroup.co.uk/forum/natwest-bank/105227-nat-west-claimants-new.html for further info (just scroll down to the AQ stuff) and, if you decide to go ahead, PM me with your email addie and I'll fly attachment 1A over to you! It's a way of turning up the heat on cobbetts - and I seriously think it worked in my own claim! Obviously, as you have the N150 as opposed to the N149, your info would go in section H as opposed to section G on the N149 - but it's well worth attempting anyway! x ;)
