    • Hi, I am aware there’s been few threads about this already but just wanted to confirm information on my case. I was with Village gym last year(2023) on initial 6 month usual contract they do, I lost my job and due to that I couldn’t afford to pay for gym nor I had any motivation to go to gym at that time so they sent me arc phone message in September 2023 that I owed them £140 so I paid them back on instalments in 2 months time.  Then I started receiving new years deals in December 2023 and I decided to give them a call but they never mentioned anything about 6 month contract or anything, only that it would be monthly rolling contract and I paid them for 2 months and then I realised both months they charged me £59 instead of £38 they offered me on the phone when I mentioned that I am still student, even though before I was paying £43 a month in mid 2023. I spoke to gym entrance lady and she said I should give a call to gym on the phone number so I did and whoever answered said they’ll pass my info to manager and he will give me a call back in 24 hours, of course no one called me back so I called again and they said same thing. And of course once again no one got in touch with me so I got tired of them charging me more than they should and decided to cancel my direct debit and stopped going there as I got new job with rotation shifts which is not good for me as I cannot visit gym after I finish at 10pm every second week.  And now in April I received arc message saying this :  Also they have my old flat address where I used to live. What is the  best thing to do for me please? Thank you!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hey all :)

 

Halfway through claiming a few charges back through Nationwide at the moment and they've said if I go to court they'll close my account. Which is fair enough, they exercise the right to do that (yes I actually read the T&C).

 

The trouble is when phoning them up and talking to them, I always get some nice young lady on the phone who isn't overly sure of what's going on because the legal notice about the banks charging too much is fairly recent. A lot of them sympathise with my situation and end up stating that they're just enforcing company policy and if they go against it it's their job on the line.

 

Again, fair enough, but I'm angry and want to vent my feelings at the company for their policies, without shouting at some poor lass in the call centre who's just doing a job for minimum wage. It's not her fault, but don't know how else to get my point across, even if I write a letter there's a poor person at the end stressing about me and my "complaint".

I suppose so!

 

I've just seen a lot of hate on the other threads on this board towards the people dealing with their complaints and people puposely wanting to cause grief to the employees rather than hit the company where it hurts.

 

I will be getting back what is rightfully mine, I just don't want to hurt anyone whilst doing it :)

Where we see people aiming criticism at bank staff we will always state the fact that the staff are not to blame - they are just following the process they have been told to follow, and are working from scripts that they have been given.

 

Very often staff on the front line have the same problems we have, and a large percentage quietly support what we are doing.

 

The exception to that is when we see letters from senior managers which contain blatant untruths, and attempts to bully people into accepting less than they deserve. Often managers at this level have the ability to change the banks policy - or at the very least, they have the option of not directly lying to customers.

 

I am happy for a manager to say to me that he is not authorised to repay my fees - what I am not happy with is when the same manager says that the bank has never agreed to pay any fees back to anyone, and any court action will result in the bank claiming huge costs!

Surely this breaches the banking code as it seems to be a retaliatory action because a claim has been made.

Can you tell us who said they would close your account.

I would then write to Charles Bacon (a Nationwide Solicitor) stating that you consider the action threatened as being against the code of practise and possible unlawful
