Hi

 

I have already had my list of charges back and duly sent off the letter asking for my money back, £964.00. They recieved my letter on 26th april so I am just waiting for their reply.

Today I have recieved another letter from ROXBURGHE debt collectors regarding Nationwide and saying that the way I have handled my account is unacceptable blah blah.

I rang them again and told them that the account was in dispute and I was awaiting a reply from Nationwide.

The guy said "fair enough madam, we will issue you with a summons" he then informed me that I would get a CCJ etc. Then he put the phone down.

I am VERY worried now, does anyone know what I should do?

Nationwide have already registered a default on my credit file for non payment of charges as I got a new bank and refused to pay any more!

there are guidelines DCA's must abide by, two of which have been broken according to what you say.

they are only a DCA they have NO LEGAL POWERS.

 

stop worrying, its scare tactic's they should not be using.

 

you are quite right, the A/C is in dispute & it is nothing to do with them unless they have brought the debt outright & even then they should not be threatening you.

 

i would not ring them or speak to them again on the phone. get everything in writing.

 

there are template letters for telling the DCA this & about harrassment.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

they cannot take you to court, the account is in dispute.

they do not have the powers either.

if they did start this process you would get lots of other letters first.

most of which claim to be legal services working for, or solicitors working for them. most times again it is just another dca they have involved to bluff you.

 

stop worrying.

 

there are hundreds of threads regarding dca's and their tactics.

have a look in the debt collectors section/forum.

 

court summons is a very long way away, and very remote.

you have put the A/C in dispute.

they cannot nor dhould not be even processing your information at all.

 

this is the pitfall of speaking to dca's on the phone. it can never be proved what they have said.

 

fire them off a letter informing them it is in dispute and to hand the a/c back to nationwide. you are dealing with them direct.

 

do a bit of reading.

 

it will make you feel 100% better
