  1. Hi Nationwide had a judgement by default entered against them by me on 14th June. They have still failed to respond so am just about to issue a warrent. Has anyone else had this?

  4. looks like i am in exactly the same position as you, well almost. i filed a judgement by default today because nw have not even aknowledged the claim
  5. Has anyone won by default after the 14 days were up for nw to either aknowledge the claim or file a defence. My claim was deemed served on 30th may and 14 days were up yesterday. I spoke to Northampton this morning and they told me nothing at all had been recieved and to go ahead and file judgement by default. I have just checked online and the default has been issued. Can nw still put in a defence now that the judgement has been issued to them?
  6. Hi, today I have requested judgement by default as I have not heard a thing from Nationwide or indeed anyone in relation to the claim I submitted via MCOL on 25th May. It was deemed to have been served on 30th. Their 14 days are up today so I thought why wait, they wouldn't give me any extra time were the boot on the other foot. MCOL went through without a problem this morning and it says they have accepted my request for jusdgement. Has anyone else had this and actually got there money or has anyone done this but MCOL is slow and Nationwide have actually aknowledged/defended and they have just not updated there system. Surely though if that were the case I would have heard something from either the court or EVERSHEDS through the post by now?
  7. Nationwide have reached the 14 days from the date of issue to aknowledge or file a defence. I have heard nothing so first thing this morning I have requested judgement by default. If it so happens that they have put in a defence at the last minute then they only have another 14 days anyway. I don't see the point in waiting

I had a letter from KPR debt recovery, my husband noticed that right at the bottom of the letter amongst the small print that "KPR is a registered business name of Nationwide Building Society" They are lying to you when they say they have never heard of KPR. When I refused to deal with KPR they passed my "debt" consisting solely of charges to ROXBURGHE debt collection who are a nasty little company and like sending really horrible letters. I wrote to Roxburghe and told them that the account was in dispute and therefore I wasn't going to deal with them and to tell them that if they wanted to communicate with me to do it in writing. So far they have ignored this request and keep phoning and leaving messages, also sending text messages to me. I have also had more nasty letters. I am ignoring them all but saving them up so that I can put in a complaint once I have finished dealing with nw.

  12. thanks again, will definately report them for harrassment because thats what it is, I still have copies of the letter and the email I sent saying the account was in dispute and to stop hassling me! I have ignored both the home phone messages and the text message asking me to ring them as I think this is a way to start threatening me even more! I said that I was currently trying to get charges back and they said fair enough but we will take you to court anyway because we have the right
  13. thanks for the advice everyone BUT have found out today by speaking to my bank that I have actually overpaid just like I thought I had, so their court stuff shouldn't happen I hope? I am waiting for them to refund me and then I am going to put in a complaint to trading standards or whoever it is that takes complaints like mine! They seriously stressed me out and there is no need to treat anyone like they have treated me whether I owed money or not!
  14. thanks guys my 'debt' is with nationwide, i have already paid over £960 of charges which i am currently trying to claim back. The bit that the dca is involved in is a balance for charges applied to my account after I had stopped using it and which I refused to pay. It consists of nothing but charges and they have registered a default on my credit file for going into unauthorised overdraft (never had a proper od). The dca is really stressing me out, I have emailed, written to and phoned them telling them the account is in dispute and I am dealing with nwide directly. I asked them to stop contacting me or if they did then to only contact me in writing. So far they have sent me a letter saying I have 72 hours notice before they commence court action, 2 messages left on home phone asking me to call them and a TEXT message (i never gave them my number). They are clearly ignoring me but I am getting a bit scared now. The letters I have had are horrible and say things like to ask my self whether i could be made bankrupt, go to prison etc! They are just plain nasty:?
  15. hi can someone tell me exactly what a cca is? i know it stands for consumer credit agreement but how can it help me when I deal with dca's?
  16. Hi I am having hell with logic group/eos solutions/downland debt recovery Like you I have been paying a debt for over a year and I had a letter from downland stating what my debt was. I totalled up what I had paid and it appeared to be more so I wrote to downland/eos and told them I believed I had paid the debt and therefore I was stopping the satnding order BUT that if they thought I owed more then to write to me with a full breakdown of the original debt, amount supposedly outstanding and amounts they thought i had paid. They sent me a basic letter saying I owed them another £70. My husband said that he would pay the £70.00 on 18th may and then we would dispute it as all the stress was upsetting me. He paid it on the 18th like he said and the next day I recieved a court summons and they had added on £70 costs. I rang eos/whoever in tears because I read on the summons that the money should have been paid before the summons was issued to avoid paying the costs and getting a ccj. I didn't recieve the letter from eos until 13th may, paid on 18th may which was hubbys next payday and recieved summons on 19th may. The lady on the phone started shouting at me and said it was my fault i stopped the s/o. I said to her to stop shouting and she said she wasn't going to explain it all to me again because her colleague had told me yesterday that I would need to pay the costs on top to avoid a ccj, even though i explained that the amount had been paid just the day before i recd the summons! I really don't know what to do, oh and the horrible cow i spoke to is called jenny!
  17. Hi I have today done my mcol for the charges plus interest that I have actually paid. Nationwide refused to shut my accounts and so they are both showing as od with nothing but charges. These charges I refused to pay. I have stated on my claim form that I wish for both accounts to be closed, the default removed from my file and the charges that I havn't paid to be wiped out. Is this right? I also hope nw send me a cheque as it would be just like them to pay into the od accounts and i would have to claim again. Also nw have a dca after me and they keep ringing me and writing letters saying they are taking me to court even though i have told them that the account is in dispute, has anyone else had this. I have actually told them 3 times over the phone, once by email and once by letter and they still keep on scaring me

  19. Hi I am just about to do the mcol and I wondered if I can claim my costs back within the amount that I am claiming or do I have to wait and see if they pay up and then claim my costs back?

  21. Hi I have already had my list of charges back and duly sent off the letter asking for my money back, £964.00. They recieved my letter on 26th april so I am just waiting for their reply. Today I have recieved another letter from ROXBURGHE debt collectors regarding Nationwide and saying that the way I have handled my account is unacceptable blah blah. I rang them again and told them that the account was in dispute and I was awaiting a reply from Nationwide. The guy said "fair enough madam, we will issue you with a summons" he then informed me that I would get a CCJ etc. Then he put the phone down. I am VERY worried now, does anyone know what I should do? Nationwide have already registered a default on my credit file for non payment of charges as I got a new bank and refused to pay any more!

(the gun bit) and yes i received a bank statement from them at the beginning of this month so they do have my address! they have now passed my "debt" over to ROXBURGH debt collectors. this is for the charges that I refused to pay but i have already paid out approx £960. they are still charging me every month for being in an unauthorised overdraft even though i stopped using the account 18 months ago. they refuse to close my account and i have flatly refused to pay any more so this is why they send the threat letters. they orriginally sent my "debt" to KPR debt collections and when i read the small print it says kpr is a registered business name of nationwide building society!! i am completely prepared to fight this all the way though but what really annoys me is that they have registered a default notice on my credit file in relation to non payment of charges!
  23. I stupidly didn't send it recorded delivery though so I only have the proof that the cheque was cashed on 23rd march! my fault so will have to go 40 days from there. I have just phoned them and they said that my address was showing up "untraceable" meaning according to the lady i spoke to that they have had post returned. I told her that I have been receiving plenty of threat letters and have lived at this address since i opened the accounts. she said that the dpa stuff wouldn't be sent to me but would be sent to a branch and i would have to collect them from there! also the brance would write to me once they are in! is this a delaying tactic!

  25. Hi I have just this minute got off the phone from Nationwide dpa team. I thought I would ring them to remind them they only had until 20/4/07 to send my copies of charges through considering they cashed the cheque on 23 rd march. The very nice lady told me that there was a problem with my address and that they had "had post returned" so my address was showing as untraceable or something. I said to them that I have been receiving post from them in the form of threat letters and that I have been at this address since I opened the accounts! Wonder if I should give them another week or not as she said that they would not send the fpa request to my home address but that I will have to go into the branch to collect them and they will write to me once they are in!!
