Hi, just a little advice wanted, My dauhter has an overdraft of £1000 which has been overdrawn over a failed D/D. Charges have been added to the account over the last 3 to 4 months, I have requested the return of charges,They argreed to return half of the amount. We sent the letter before action and have recived no reply, but if I take court action they will continue to added charges on, which they apply to the account with advanced notice of a month or two.As these charges have not been taken out then I am unable to claim in court. It seems the only way is to bring the account back into its limit and wait until all the charges have be taken out then ask for them all back in two months time. or take court action then.

You can add charges right up to Court action.

You can even add charges once the claim is filed in Court but you will not get the court fee back.

Besides Halifax are not known for dragging court cases out so it would not really be worth the wait since there will not be much of that.

Refuse the part refund and demand the 100%.

Its likely that Halifax will issue a warning over future conduct so a parachute account is essential.

You can of course launch another claim later for additional charges but better if you can to try and prevent them.

hey guys, looking into claiming my charges back from the halifax... got a letter yesterday regarding an account that i haden't used, went to the bank today to get my wages out and they had transferred money from one of my accounts to the other.. i phoned them from the branch and they told me that they were well within their rights to do this and would not refund any of the money that they had taken yesterday into my account. whats more one person told me one thing and another told me something completely different. the charges i'm looking at claiming back total just over £3,000 approximately. what would you recommend for me to do??

You've definately taken the first step into claiming back what's rightfully yours.

 

Spend time reading the FAQ's and the Step by Step guide as this will stop you making mistakes along the way. Use the letters and spreadsheets in the Templates Library as these have all been tried and tested in successful claims. Read as many threads as you can especially ones that relate to your bank. This is a SELF HELP site and won’t do the work involved for you. However, everything you need is on here somewhere.

 

Don't be afraid to ask any questions, no matter how stupid they may seem, but please remember that any advice that you receive is normally based on experience only and that you should seek expert advice if required.

 

Once you start the process of your claim remember to open a thread in the relative bank forum, this will enable you, and others helping you, to keep track of your claim.
