    • Hi Guys, well a year on and my friend has just received this in the post today, obviously a little scared so looking for more of your advice.  Letter from the NCC dated 1-May-2024 is as follows.......   Before deputy district judge Haythorne sitting at the national business centre, 4th floor st Kathrine's house Northampton Upon reading an application from the claimant  it is ordered that  1. The claim be sent to the county court at #### (Friends local Court) Because this order has been made without a hearing, the parties have the right to apply to have the order set aside, varied or stayed.  A party making such an application must send or deliver the application to the court (together with any appropriate fee) to arrive within seven days of service of this order.  If the application is one which requires a hearing, and a) the party making the application is the defendant: and b) the defendant is an individual, then upon filing of the application the claim will be transferred to the defendants home court.  In all other cases requiring a hearing the claim will be transferred to the preferred court.    As a result of an order made on the 1 May 2024, this claim has been transferred to the county court at ##### (friends local court)

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Having been through the whole saga from first letter posted on 2nd Jan this year, through to MCOL, we have just recieved a court date for county court on 30th July and a request for copies of all documents etc.. to be sent to other party and court, I assume this is the court bundle, no later than 14 days before hearing. Notice of allocation also states that claim has been listed with a number of similar cases..Does this mean the courts are getting the hang of these claims and dont really expect to hear them all?

I have read many threads on this site and I'm reasonably confident of things going smoothly, it seems to have been straight by the book up to now, any Ideas if we are likely to receive an offer before or after court bundles are posted or are Abbey likely to leave it until 29th July...

I have also read with interest litigation costs being claimed, do we have to state this anywhere in court bundle? as I think 30 hrs minimum sounds about right.

aq's arent being sent as standard anymore. I had the same letter with the aq section crossed out from croyden county cc saying I had to provide court bundle ect. Costs can be claimed but i'd say 30hrs is a bit high and may be refused. I'm going to ask inga/james for 13hrs plus £6.50 for each letter sent plus I have sent almost every letter by registered post. when they ring to settle I will demand these costs. If they refuse to offer costs try sending this letter

Just to let you all know we received our full settlement offer today from Abbey, 5 days after we sent court bundles and 10 days before court hearing, just waiting for funds to clear. Not going to make claim for litigation costs as Abbey have offered £100 more for court fees etc. so we are more than happy.

Once funds have cleared I'll make donation, thanks for all the info on the site. Any new claimers reading this just follow the system all the way to the end...and you will surely succeed.
