    • Oh, one other thing. It may sound a silly question, but as they say - silly questions are better than silly mistakes. The correspondence address in the current case and the previous one is correct and current. I've never actually written to the banks to confirm my address, as is regularly advised, because I presumed if Moriarty/IDR/J&P are using that address, there would be no need to. So because both cases seem to have my address correct, should I still write to the bank or take it that there's no need in this instance?

    • Hi all Just coming back to this Forum, as it helped me so much a few years back with ADCB/Moriarty. So I've had the circulars from IDR chasing Emirates NBD debt. They've been on and off over past few years, seem to be a run of letters, emails SMS and then go quiet, then start again.   A few months ago, same started with J&P, just a basic letter, email, sms asking to get in contact. Then last week I saw an email from Emirates NBD saying J&P were acting on their behalf. Up to this point, the main thrust of the letter seems to be please contact us, or contact ENBD about payment. Then I received a letter - I can't scan/upload it at this time but I will as soon as I can - which appears to be similar to what I've seen on other threads. Namely giving bank details of ENBD, saying they've been "instructed to pursue action", and saying they've enclosed a copy of Information Sheet, Reply Form in compliance of Pre-Action Protocol They state I have 30 days from date on letter to reply, and "if you fail to do so our client may have no option but to pursue further action against you". I'm of the view, as per advice on other threads and my experience with the other lender/company, to reply as per thread #5 in the main thread. On the basis that I wouldn't wish to give them ammunition by not replying or missing the opportunity. I'm aware that on some threads, in similar situation, one poster had been advised by sols not to reply and apparently J&P didn't progress from there, other than sending same requests. I feel these things are always down to the individual's choice, and I'm keen to see what others may have done/may be doing so will actively read other threads also.   Please feel free to ask if I can help with anything, or share any opinions, and in the meantime I'll get the uploads done ASAP.   Thanks again for everyone's help in the past, and hopefully the future, and good luck to all

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

panic over got through after 30 min i did put date on must of come of the page when copied spoke to a nice guy called tim said i should hear by next wednesday they are working on my claim so we will see so we will see which way it goes

Hi Tilly

 

I am sending my LBA on 8th May and will start my mcol on 22 May, as looking at the mcol site they start the claim on the following day. So looking at your dates would say that you should start your mcol on 11th May, that is your 14th day. If I'm wrong hopefully someone out there will put us both straight!? How are you feeling about it all?

its both exciting and nerve racking just wish they would settle and be done with it the other half is sulking cos ive pinched his pc i did ring them up yesterday waited 30min was told my claim is being dealt with will hear by next wednesday talk about leaving it to the last minuet but it will most likely say we have blah blah how are doing

been reading other threads on mcol and n1 forms dont want to seem thick but the more i read the more i got confused what is the difference between them dont want to muck it up when i start to file court papers which one do i use

You use which ever is easiest for you. There is not really any difference.

You can fill in the mcol forms without having to send them, might be worth a try looking.

 

If not all the N1 forms are on here aswell.

just to add i opened a new bank account tody with nat west i cant remember what thread it was but they mentioned a step account thanks for that if you reading this thought it best just in case might not need it but you never no:)

hi i have printed of n1 forms think i got the jist of them now its the interest bit that is confusing me been on vampiress but theres different templates which one do i use file my claim next friday so i want to get this right dont want to rush it and make a mistake

Fast track is when your claim is over £5k, the court allocates it.

Your claim date is the date you sent your SAR.

 

If you use the simple version on the spread sheets it will work all the interest out for you. And the daily interest as this gets added now aswell.

 

Dont forget to add your SAR fee to your N1.

right managed to find spreadsheets but more confused than ever there are so many colums where do you start and also how do you work out the daily interest i need help here starting to painic court day drawing nearer

you only need to fill in the first 4 colums.

 

"Charges as notified...Amount...Date......Interest"

 

The interest will work itself out.

The daily interest is easy aswell. Take your charge total (including interest if you have an overdraft) and times it by 0.00022
