Hi

 

Between two accounts with RBS, I am claiming over £7k with contractual interest. With all my other claims, I have been following the process myself, prelim, lba and small claim/summary cause.

 

I am however a bit nervous about claiming against RBS due to the amount of the claim. I don't want to lose and have to pay costs.

 

I do know that losing is unlikely however I simply can't afford to lose so can anyone offer me some advice. I was going to use a solicitors firm however I know some people on here have said to defend it yourself and don't give up any of the money you are due by paying someone to do it for you.

 

Incidently, they haven't even made a single offer yet and they have sent me the statements 3 times now. I think they are in a bit of a mess with all this.

Whereabouts are you with the £7k claim for RBS?

 

Due to them not respsonding to you apart from sending out 3 sets of statements then I would file a claim on MCOL as you have in the past.

 

If this was my money I would not employ a third party who will only take a large chunk of whatever you get back-you have gone done the MCOL route in the past so why not stick to tried and tested system.

If you want some encouragement, there are plenty of "live" threads for more than 5k and a lot of "successes" too. Providing you get your paperwork right, there's no need to worry because the banks haven't got a leg to stand on.

 

 

A few RBS claims in the 5k+ category are HydraUK, mcuth and livelylad. Might be worth finding these and having a read through.

 

 

It would be interesting to know as ppman asked how far through the process you are?

There still are options available to you however, I can't really say because I'm not entirely familiar with the process. There are a few people on here who are currently claiming from scotland for a LOT of money. One notable one (against RBS) is seahorse. He is an extremely helpful fellow for a scot (:D) and I'm sure if you posted on his thread with a link to yours asking for his advice, he'd be more than willing to give you some.

I have sent LBA and the deadline expires tomorrow.

If you are worried about the time it is taking to get a response from them, there are backlogs in RBS at the moment. That isn't an excuse really but you may consider waiting before going to court. Again, if you read Seahorse's thread I believe he has allowed for the delay in his process. People everywhere are experiencing a "backlog" response from RBS.

 

Have a read around to see what people are doing, it may be of use to you before you go ahead with a court claim especially in your circumstances give the amounts and where you live.
