      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

A couple more things to add re all this...Kinshill No1 have never informed me that they've changed names- as far as I'm concerned- they still own the alledged debt... AND Robinson Way are trying to collect my alledged debt for cabot/kingshill...so what' the score with that...are Cabot guilty of also sharing my data with yet another company (ie RW) ?? ... Have i got good cause to fill out that complaint form ?

A search on the Information Commissioners Office register for Robinson Way reveals 'no matches'. I have also read on other threads that they are apparently not registered. :rolleyes:

I know I would normally post this on my own thread (info on Cabot) but I really think the likes of Seahorse, Tbern, Elizabeth, Rhia etc would be interested...This is what Mr Maynard has been campaigning for over the last year or so...click on the link and read the whole thing (i.e. means clicking on the 'Document' links within this text piece)-- VERY interesting!! I think, in the Debt Collection trade, this is what is known as 'White Data'

Ditto to giving this a good read later but the quote from Seahorse ties in with the issue of the properly executed agreement. (Which is being discussed in great detail elsewhere on this forum)

 

Many of the so called contracts are just the original application form and when the consumer signs the little box it is usually only to give consent to use of your info for the original lending decisions and fraud prevention. The real permission to allow sharing of data to third parties should be in the full agreement which contains within it full terms and conditions. And then there is the argument that you do not give your consent in perpetuity.

 

From my research, Cabot has been trying to pass off a number application forms as their authority to share personal data ad infinitum. We all know this is wrong but we need the IO to agree. It will be interesting to see what the various complaints to the IO yield.

In the court cases coming up soon it would be fun to have Mr Ken called as an expert witness for the claimant. He does seem to write the occasional article which gives info that his organisations seem to ignore.

I popped home from work at Lunch time and I have finally had a response from an unnamed person at Hodsons...

 

I will post the whole letter tonight, as it is 3 pages long..

 

Anyway, here is a couple of highlights you might enjoy

 

'Cabot Financial (Europe) Limited is contracted to act as an agent for Cabot Financial (UK) Limited (formerly Kings Hill (No.1) Limited.) Your subject access request sent to Cabot Financial (UK) Limited was passed to Cabot Financial (Europe) Limited in order to process the request. We are instructed that Cabot Financial (UK) Limited does not hold any data to which relates to your request.'

 

'For avoidance of doubt we are instructed that cabot Financial (UK) Limites does not hold any data about you. It is Cabot Financial (Europe) Limited that holds the data and therefore it will be that company which responds to any subject access requests directed to the Cabot Group'

 

They have also confirmed that for the purpose of the CCA 1974 they are the creditor.. (not what they have claimed in their defence)

 

So.. Even thought Cabot Financial (UK) Limited are the legal owners, they have no data about me, but Cabot Financial (Europe) Limited does have all the data..

 

Ermmmm so where exactly did (Europe) get the data from then ?????

 

Nice of them to contradict their own defence in writing though, always a benefit...

 

Anyway, I have to leave now to get back to work.. I will post some more tonight.....

So Cabot UK (formerly kingshill) have no data on you (us) so are they sharing this nothing with the CRAs.

 

and as you say where did cabot europe get the info from.....

So despite owning the supposed debt, they don't hold ANY data about you? How do they know about you then? They hold no data, ergo, your details are not held in any system of storage recognised under the Data Protection Act, and so they shouldn't really know ANYTHING about you. So how is it, that KH(No1)Ltd aka CF(UK)Ltd are able to pass data to the CRAs if they don't actually have any data to pass on?????

 

Get Mr Maynard to a hospital quick!!!!! I wouldn't like to see that foot wound turn gangrenous!!!!! :-o

 

This is obviously how they intend to avoid the issue of any complaints that they are not listed in the Public Register. I can't wait to see the reply that I get back from good old WW. He's promised me one by early next week.

This is obviously how they intend to avoid the issue of any complaints that they are not listed in the Public Register. I can't wait to see the reply that I get back from good old WW. He's promised me one by early next week.
