    • This is essentially a shared area where there is some private parking but there is also customer parking for a shop that is labelled as customer parking with a time limit of 30 mins.  A friend of mine also received a similar notice around the same time so I assume they are just trying it.  The photo evidence doesn't really show anything as it is pitch black and shows an entry and exit less than the 30 minutes allowed in the customer parking spaces.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Citizens Advice Bureau

I have just been down to my local CAB to discuss an unrelated matter.

 

Whilst i was there i asked one of the advisor's whether they have many people coming in with bank problems,charges etc.

 

We got talking and i mentioned Consumer Action Group/Bank Action Group and the help that had been given to so many people and she thought it was great.

 

I asked if she would be willing to pass this information on to members of the public who come in or perhaps put up a leaflet giving site information.

 

She is going to have a word with her manager so they can look into it and whether they will be able to recommend it.

 

I have another appointment on 15 May and will see what the outcome is.

 

Has anybody else mentioned this to them.

I posted this under General Knowledge but has not had too many views so i am copying it here.

I said they could make some money by selling it to people that they advise for free and off of there own backs.

hi ive just read one of your posts and the consumer credit counselling service know about this site as i had my appointment for my dmp on wednesday and had a good old chat with my advisor about halifax and this website and she said let me know how you get on as it will be interesting to pass on to other clients, just thought id let you know that they are aware :razz:

I am currently sorting out a DMP with the CCCS too so i'l tell them about my claim too- my ex is getting advice from the National Debt helpline at the mo si il get him to tell them all about it too!;)

Thanks for the response. I am glad this is getting some reading.

 

I am trying to convince a good friend of mine about the process and this site but he is very skeptical.Not until i receive my charges back that he will do something about his.To be fair he has not really put any effort into reading this and thinks its hearsay.He will be proved otherwise and be converted.

 

 

If this could be recognised by a professional body then this would go a long way into helping those who either don't know about this or feel that it is some kind of fad and that it is a place where everybody can help each other and reclaim back what is rightfully theirs.

 

What the moderators and administrators who have set this up and run this have done a truly wonderful job for the help of people and for no monetary gain whatsoever.

 

Coupled together with sites and forums such as Money Saving Expert this can really let people gain control of their lives and finances and high lite the necessity of the power of communication for people after the same goal.

 

Long may it continue.

 

I will leave feedback on Monday as to the outcome from CAB.

hi it is good news isnt it. although my advisor had heard that you could claim back charges im not sure if she saw it on telly or elsewhere but she did know about it i told her the name of the website as well, so its good for other people who go to cccs and ndh that they will be informed that they can do it.

Good luck to you...i do think that the more people who know about this site such as the cccs the better. I bet half the people who ring the cccs have been affected by bank charges!

I know its fab! Can't wait to see how mine will turn out! I think i will have to keep referring back to your thread for help when i have to make a claim. It seems to be turning out like yours - haven't heard anything from Halifax at all!

 

Anyway i am really chuffed 4 ya - hope your head isn't too sore in the morning - but if it is u can go out and buy some painkillers with your Halifax card can't u!
