      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi again all,

MANY thanks for your on-going help & support, where would I be with out you all!?

I have now found another link to the N1 form - it takes you to the form OK, everything on Page 1 of the form works, but the big section on page 2 (particulars of claim) won't let you enter any information in the box... you can click on it, but no flashing cursor comes up enabling you to type...:-x

does anybody have any help / advice for me, or a blank form saved anywhere that *does* work??

It's so frustrating, cos only get a couple of hours a night to work on stuff - and spent most of last night trying to work the darn thing out!!

yeah I know I COULD use MCOL but would rather use the N1 as I have already spent one night working it all out and I have written everyting out... just need the N1 form if anyone has it...? (see above for what's going wrong...!) cheers, Msbanana:confused:

Hi again, yes I AM doing it at the court, but am trying to use the N1 form that you fill in online... the form has a problem with it.... (the link you forwarded me is the form I am using, but as I explained earlier- there is a problem with page 2 of the N1 form) this is getting really frustrating!! can anybody help me?? I do not want to use the MCOL forms - I want to use the n1 and cant get into town to pick one up from court...

As long as they can get away with not paying is about the time you will have to wait!! LoL! :-x

 

Mine took 3 months from filing to paying up, they paid :D up on the eve of us going to court for a prelim hearing (this was after the AQ stage).

No, don't do a thing. Lloyds will have 14 days from deemed service date to acknowledge and then a further 14 days to enter a defence. The form only has to be filled in if they do not enter their defence.

Have just received a 'Notice that Acknowledgement of Service Has Been Filed' through the post with regards my claim.... do I need to do anything, or just keep waiting...? :confused:

hello all you helpful folk out there... I have recieved my allocation questionnaire... any help filling it i would be very grateful... also - vary surprised to learn I have to pay another £100.. had I known that I would've thought twice about doing it now... loads to pay for next month & very skint if truth be told. :mad:

I have now done my AQ and is all ready to post... what do I need to do now? post the thing and wait? or is there something I have to forward the defendant? did I read that somewhere or did I imagine it? confused...:confused:

I did my AQ thing a while ago, but did not post a copy to Lloyds - can somebidy let me know if this needs to be done? and if so - is there an official letter to send?>?? and to whom does it need to be sent? lloyds, or their solicitor? help! :confused:
