Harper Macleod entered a defence and wrote to me offering settlement £80 is excess of what I asked for, all on the same day, the last before I could could get a default judgement!

 

Still havent seen anything of it though!

 

My hearing date has now been listed as 5 July!

You're right just to let the court system continue until you get SOMETHING from them!

 

\i haven't had a chance to find out what's going on with my court claim today. I'm a bit busy, so I will try to get in touch tomorrow.

I finally got my notice of issue today- they are absolutely snowed under at Liverpool County Court!

 

I handed it in on the 25/5/07, it says the claim was issued on 31/5/07. The court sent it to the defendant on 11/6/07 and it will be deemed served on 13/6/07.

 

Is this longer than it usually takes or about normal?

 

SLC have until 27/6 to reply. I can't wait!

Does seem long, Im going through Basingstoke CC and I handed N1 in on 1 Jun, sent on 7 Jun so deemed served 9 Jun!!! Roll on 23 Jun!!

I STILL haven't heard anything from the SLC and their eminent solicitors.

 

Soon it will be judgment time- I wonder if it will get as far as bailiffs?

I've never had them not hand in a defense, but they'll probably do the usual and hand it in at the very last possible second.

I haven't even had an AQ- they've acknowledged, stating intent to defend- but no defense yet.

I posted them my deferment form and evidence for a three year deferment last week, recorded delivery. Still not a word from them on that either.

Well, they seem to have ignored the three year deferment application, and have only deferred for ONE year. And sent me another letter asking for the arrears and charges. This is why I hate them.

 

I phoned, got someone who seemed decent enough(still don't trust them though), who is emailing the special cases deferment dept to question the decision (which I don't think my registered post ever got to).

 

She is also emailing the legal dept, to ask them to contact me- because the 28 days looks to be up on the 11/7/07.

 

Oh to get a judgment on the SLC- happy days!!!

Another phonecall from SLC. So I phone them- they want me to pay back my arrears- thats the SECOND time today I've had to tell them I'm taking them to court.

 

Again, they try to argue. Again I tell them I'm not paying anything until the dispute is finished.

 

Then they tell me that I have to phone Smith Lawson for one of my accounts.

 

So I phone Smith Lawson- they tell me they can't find my account number! And promise that WHEN they find it they will ring me.

Emma- if they are demanding payment for a sum which is legally in dispute, you MUST phone the Court and tell them.

They will be VERY interested.

 

Phone Trading Standards as well and tell them whats been happening.

Also WRITE to the court as well, so the judge gets to read it.

If they ring again tell them you will be delighted to make arrangements to pay them whatever you legally owe them after the dispute is resolved. Ask for the name of the person ringing you then tell them that these demands for payment will be reported to the Court and the caller named.

Whenever it is, you MUST go and put your case to the judge in person, and let them know what you have been put through by these scumbags.

If they've put in a defence, you should get a copy of it with the notification of the hearing date.

 

Alternatively, you could just ring the Court yourself.

Can I just ask why you believe 12 July to be important?

 

If they have put in a defence, they have acted in accordance with the rules and its now up to the Court to set a date for a full hearing.

 

If they are still hassling you, contact the Court.

I haven't heard anything from them apart from the acknowledgment. They are allowed 28 days from the day of serving (if they ack and intend to defend) to lodge their defense.

 

After the 28 days, you can apply for a judgment to be made against them, if they have not lodged a defense.

 

As there is no sign of a defense yet, I'm getting ready to go for a judgment when their 28 days are up.
