      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I knew the word was something to do with the army or guns or battles or wars or planes.................. Oops, nearly there......... lol lol lol xx dont they get sore trouser rubs going commando............ eughghg perish the thought. My friend used to work at casualty at the hospital and some of the stories she told about men and things coming in for treatment i.e. removing stuff from places, used to make me nearly wee myself. And Im serious........... the stuff she told was actually true, wot some of them did with implements, not only their hands round their tackle but other stuff too. God it was funny. xxxx

See ya Hedge, gotta to go water my lovely toms and fruit trees Ive bought now. Then try and find a nice palm tree on e bay to buy for planting next to my lovely new deck. Yaaaaaaaaaaaaaay, I will feel like Im in the Med by the time my deck is finished and lovely palm trees planted next to it. Yaaaaaaaaaaaay for summer gardens. Off myself now peeps to feed my plants. I think so too. Not done diddly myself apart from water the newly planted plants to help them on their way.......... garden a bit like a bomb site at mo with new deck & pergola half up half down, half deck done, half not, holes everywhere, planks of wood, trampoline on its side looking forlorn, and lots of other plants sat at the back of the garden waiting to be planted................ a bit like beirut on a good night.................. so gotta wait for all work to be finished in garden before I can tidy it all up. A week or so away then yet, piles of rubble, and new grass to be laid. What a mess !!!!!

Lol.............. it'll look 'fab' when it's finished though honey! Gotta say - we've cheated!!! After years and years and years of replacing turf due to kiddies playing football, paddling pools, slides, water slides, dirty big sycamore at bottom of garden ........... you know what I mean!!! ............. we've astroturfed!!!!!! :eek: I know it's cheating - but couldn't bear to see any more grass 'go to turf'!!!!!!!!!!! Totally agree with you on the deck thingie though. Our garden's pretty small really, but the best bit is the deck!! Love sittin' out there in summer (or any time of year with the heater on!!!!!) ............ makes you feel as though you're on holiday!!!!!! In about 4 weeks though............ your garden's gonna be like sittin' out in the med somewhere. Mmmm...... yummy!!!!!! xxxxxx :p

I know Hedge youre right. Im busy looking for nice palm trees on e bay cos I want it to feel like Im on holiday every night through summer. Lol. How sad are we.......... I thought about the astro turf stuff, cos kids always playing footy on grass but hubby wont hear of it. It would be more practical I agree, but he says you cant beat the smell of fresh cut grass, so hubbys orders Im afraid. Weve not done too bad. This will be the first time weve replaced it in the 11 years weve lived here, so its done ok, and it only got wrecked end of last summer when we were building the conservatory and had to have all the building materials deposited in the garden, on the grass of course, and because it took about 3 weeks to build it was all ruined at the end of it, so we resolved to put up with it through winter and get some more for the summer, so thats next weekends job............ laying new topsoil and turf. Lovely mucky jobs, Yaaaaaaaaaaaay. We aint got a huge garden. Its about 45 metres long by about 16 metres wide, long oblong shape with a lovely pizza bread oven at the bottom of the garden, so Im hoping for nice weather this summer to enjoy the alfresco experience a bit more. sitting out sipping wine till the early hours. Yaaaaaaaaaay, can have some by then. Will have finished my detox thingy........... Yaaaaaaaay, even more reason to celebrate with vino then. xx

Brilliant Fend....... brilliant!!!!!!! Do you know what? When we first moved into this house, I hated the garden! I couldn't stand mowing, weeding, or anything else. But over the years, I've grown to love the place........ to the point where even the twinkies know which are my fave plants (hence......... which ones they can't smash with a football!!!!!!!) Must be something about women of a certain age methinks - you get in your late thirties and early forties and all of a sudden the things we used to do (e.g., going out) don't seem important any more. We seem to metamorphasise into earth mothers - luvvin nature, appreciating natural beauty and the simple things in life! Like sittin' out on the deck, admiring the plants we've lovingly planted.............. whilst sipping a few bottle of ribena!!!!!!!! Lol.............. I'll be looking at Laura Ashley's website in a mo!!! Although on second thoughts...........no.......... not going that far!!!!!!! Excuse my ramblings tonight honey............ I'm in proper 'woman' mode!!!!!!!!!!! xxxxxxxxxxxxxx :p
