    • The Contract itself The airport is actually owned by the Ontario Teachers Pension Plan. There should be an authority from them for Bristol airport group  to sign on their behalf. Without it the contract is invalid. The contract has so many  clauses redacted that it is questionable as to its fairness with regard to the Defendants ability to receive a fair trial. In the case of WH Holding Ltd, West Ham United Football Club Ltd -v- E20 Stadium LLP [2018],  In reaching its decision, the Court gave a clear warning to parties involved in litigation: ‘given the difficulties and suspicions to which extensive redaction inevitably gives rise, parties who decide to adopt such an appropriate in disclosure must take enhanced care to ensure that such redactions are accurately made, and must be prepared to suffer costs consequences if they are not’. The contract is also invalid as the signatories are required to have their signatures co-signed by independent witnesses. There is obviously a question of the date of the signatures not being signed until 16 days after the start of the contract. There is a question too about the photographs. They are supposed to be contemporaneous not taken several months before when the signage may have been different or have moved or damaged since then. The Defendant respectfully asks the Court therefore to treat the contract as invalid or void. With no contract there can be no breach. Indeed even were the contract regarded as valid there would be no breach It is hard to understand why this case was brought to Court as there appears to be no reasonable cause to apply to the DVLA.............

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi.

As suggested by "bitingback" I am starting this thread for any other Abbey customers who wish to comment or advise.

I sent a letter to my bank requesting information of charges for the last 6 years. They replied to me rather cordially stating that they could not supply a list of charges to my account for the last 6 years as they do not store this information seperate from other account information. They then sent me statements for the last 14 months. They stated that any information for 2001-2005 is stored on microfiche and not available on thier computers. However they said there is a £10 charge for the provision of this information which they would then process the information upon receipt of the £10. They did, however, refund the £10 I sent for the Data Protection information. So at least I have a start. icon10.gificon7.gificon14.gif

Following the first letter I got a reply: They have said I have eight weeks to reply and after that they will asuume I no longer need the information. However I don't think I need to get the information from them as I have all my bank statements right back to 1998. The only thing I am unsure about is how to write the Schedule of Charges. Do I just write all the charges and toals on a normal piece of paper or do I have to write it in a pre-printed form? Either way I got a lot of looking at statements to do to sort the charges all out..........lol

Many thanx for the reply from "bitingback" about the way to list the Schedule of Charges

Regards

Steve

hi Steve,

if you have all the statements, then you build a schedule of charges in an Excel spreadsheet, with columns listing the date of the charge, what it was for and the amount. In order to calculate the 8% interest on each charge, add two more columns, one called "days since charge" and the other with called "Amount of Interest" You shoudl hide these two columns until you get to the court stage, which you lmost certainly will. Formulas for working out the days and interest amount can be found in the Spreadsheets section of the template libraray. Make sure to include a copy of teh schedule with each communication you send to the bank

Cheers

Rob

Use the Simple S/S here:

http://www.consumeractiongroup.co.uk/forum/bank-templates-library/182-interest-calculation-spreadsheets.html

and visual guide here:

http://www.consumeractiongroup.co.uk/forum/barclays-bcard-woolwich-successes/7226-maisielou-barclays.html#post50088

Overwrite the existing examples type of charge, amount and date.

The days since and 8% will be calculated automatically

Save it (for use later at court), then delete/hide the last 2 columns (8% bits) and print out as your schedule of charges.

Dear all there is no need to use excel or any other program. I believe there is a calculator on this site, and I know there is one on the Moneysavingexpert site that also adds on the interest automatically. I'ts so simple you just put in dates and amounts and it lists them and adds them up for you too!

True. But you can't save it, only print it out and you cannot enter the type of charge, this has to be done by hand afterwards. However, if you don't have Excel or can't cope with spreadsheets, it's extremely useful.
