They will put in a defence to 'test the waters' as it were but once you reply and they realise your not going to go away and that you want YOUR money back they'll eventually pay up... not before going through all the hassle of a court date allocated too!The key to it is of course this little gem on the n150 form (don't forget to use the pdf)"I am respectfully requesting that my claim be allocated to the small claims track. Hi folksWell guess what's happened?letter received from abbey the other day...Dear Sirwe have now conducted a complete reconciliation of your account and without admission of liability, abbey national plc has determined, in this instance, to settle your cliam in full. payment is in full and final settlement of your claim etc etc abbey is raising a cheque please inform the court etcWhat a surprise they didn't admit liability??? Even their wording of their letter is rubbish too... if they weren't accepting liability then why are they paying up???So anyway a massive thanks to you guys for your help I'm made up! Only a small amount compared to some claims on here but still another one for the little guy! Have been recommending this forum to everyone I know! if I can help anyone then please get in touch.

  7. I've now received a letter from the court reference a preliminary hearing do I need to prepare everything in duplication for this please? only thing it says on the letter is the hearing will take about 15 minutes.

  10. good luck, just keep badgering them they really do use stalling tactics and are generally incompetent in their response!
  11. When I initially started this process I was a little bit worried going up against the bank but the more dealings I've had with them the more incompetent I've found out they really are! You can see above at what stage I'm at with them so imagine my surprise when letter drops on the mat again reply to the first letter I sent them nearly 6 months ago saying thank you for my complaint blah blah blah and the charges reflect their costs load of old pony!!! :-x Their SHabbey Nickname does seem oh so appropriate! They've also I gather wacked another £50 of charges on my account too which they've obviously closed! I'm just absolutely flabber-gasted by their sheer cheek and general incompetence!

  15. got into the form now thanks all done! Love this site! Will keep you posted on the shAbbey National's response! I just cannot believe throughout all the letters I have wrote their under hand tactics to stall it all! They are an absolute disgrace! My total claim with them is only for £142 too... you'd of thought for all the agro they would of just refunded it in the first place!

Just a shame I've got to write it onto the form with my awful hand-writing sorry further just tried your link to get to the help with questionnaire bit and wouldn't get to it?
  17. I've had a letter back from Abbey saying they are defending my claim etc and have now had the court form back to fill in. Have many of you also gone this far with abbey? was it settled before you end up in court? Thanks in advance

  19. My first post! Morning Everyone! I've been reading the forum for a while but this is my first question for you... I've had an acknowledgment of court proceedings from abbey and they have ticked the box "I intend to defend all of this claim" do they do this with all of them?
