      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

A spud,! I am having a fillet steak, saute spud, mushrooms, grilled tomatoe peas and cauli and maybe a bit of GARLIC bread!!!!!!!!!

Then while the dog is kipping, I may have a cocktail or two:D :D

Only cause it's wet outside, if it would have been a nice day I would have gone jogging:rolleyes:

Luvvin' that idea of a couple of cocktails............. might join yer and whip up a nice big jugful of margueritas - for medicinal purposes only though :D :D (good for ya that lime juice innit!!!!)

 

Shame you've had to miss yer joggin honey. I can sympathise there. I'd have gone to the gym and done a couple of hours workout - but not on top of a nice full cooked English!! ;) xxxxxx

Yaaaaaaaaayyyyyyyyyy for having a bit of time to yerself!!! Boo hiss............ cos' you don't get any of that in the hedgey household though ............ I have to come on CAG for a bit of 'me' time - they even pile in the bathroom to update me every two minutes when I try to have a bath!

 

Cobblers have got till the 15th June to file a defence - which I'm pretty sure they'll do (even if it's a last minute thingie-majig). But feeling good about it now............. SO BRING IT ON!!!!!!!!!!!! Getting quite excited really - it's quite good fun this legal lark when you start reading up on it! Lol............ might retrain to be a lawyer and get a job with cobblers and bu*ger all their defences up for the nat west claims!!!!

lol my youngest is 4........the oldest is 21 then theres 18 and 11 inbetween! the 2 oldest dont live at home so for the most of it its quite nice now.daughters down for the weekend though but i havent seen her much ive just dropped her and her friend to cadbury world today .but the weathers rubbish! you got any kids enaid?

Blimey, it's half one - where's the day gone??!!

 

Hubby's taking the sons and heirs (to all our debt!!) to his mums for an hour.................. so I'm going for a soak in the bath but need to cut the chicken up first. Then he can help me do the spuds and veggies when he gets back - bless him, he seems to think I'll do it all while he's out.......... he must think I'm daft!!!!

 

Seez ya later gals............... have a lovely relaxing sunday - even if the weather's yukky at least it gives us chance to stay at home and watch a crappy old film and chill out!!!

I'm up for easy cooking too, just cheated and been to Asda bought a spit roasted chicken, still red hot so just gotta peel some spuds and stuff and we might get dinner at a reasobale time today lol.

 

Spoke to bank this morning, actually got a nice understanding person who is going to allow d/d s to go through and not charge me.

Its piddling down here, looks like its on for the day. Can't go out so may have to give in and do the ironing........

Quickie update!

 

Got home half hour ago to work from home for the rest of the day - received a letter from the rather overworked Stuart Higley saying:

 

"blah di blah......... blah di blah........... blah di blah. However, having reviewed your case and as a gesture of goodwill and without admission of liability or error, in this instance we are prepared to offer the amount of £1,136.00 (full amount of charges) paid direct to your account"

 

Usual conditions etc.

 

Problem is, I've filed at court (£120.00) and cobblers have got till next Friday to file a defence.

 

Now, I know I'm totally skint and could really do with the cash, but..............! They've ignored me completely till now.

 

What d'ya think? Accept plus the court fee - or wait for the long haul???????? :confused: :confused: :confused:

thats the same sort of letter they sent me, be very carefull, if you have any loans with them etc they will use this money to repay them, thats what they're trying to do with me at the mo but i sent them the refused offer letter back this mornin, i think a lot of ppl are gona get caught by this thinkin the moneys comin to them.
