I have used the spreadsheet and have calculated that i am owed.

 

£3303.81

 

+£801.08 at 8% (interest)

 

Giving me a Total of

 

£4104.89

 

I have claimed for 75% of the overdraft interest, not all.

 

I have read conflicting replies as to what exactly can be claimed back?

 

Is this right?

 

Unpaid Direct Debits ranging from £25 - £35

 

Unpaid Standing Order £30

 

Overdraft Usage Fees ranging from £10 - £90 (per month) and the renamed..

Overdraft Excess Fee ranging as above.

 

Overdraft Interest normally range £4 - £8

 

Can all of these be asked for.

Statements recieved 5th May 2006

Claiming back = £3913.65

 

Preliminary Letter Sent 5th May (recorded delivery) to Customer Care, Birmingham. Told me to sod off on the 9th May

 

Letter Before Action Sent 9th May (recorded delivery) to Customer Care, Birmingham. Told me to sod off on the 12th May

 

Moneyclaim filed issued 6th June (14 days to reply) Time up on 20th June.

 

Acknowledged 15th June (28 days to defence)

Time up on 13th July.

 

Defence Recieved 7th July

 

Going Before the Judge 15th September

Well overdraft interest, is for the money you used within your overdraft, so only a small % of this will be allocated towards the charges costs.

 

What is the 75% OD interest?

 

This is a difficult thing to work out, it can be done but takes brains and time! I am not adding htis to my claim as it is impossible to approtion which part of my interest relates to the charges and which part relates to spending...

Thats what i thought i should do m8,

 

I will take out all of the overdraft interest (it really doesnt bother me to lose that)

 

But do the other charges i am claiming for seem ok?

Yep any charges you can see on there, add! The only ones to watch out for are things like Overdraft arrangement fee's for instance, as the bank actually did provide a service for that...

 

Everything else claim away! Oh and keep the 8% on (just incase you thought i was reffering to that too)
