      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

8 weeks agoe, i sent off letter number 1 requesting all my statements from 2000 to 2006. They promptly sent them to me. 2 weeks ago, I sent a letter off to my local royal bank branch requesting £4,800 which had been applied to my account. I advised them that if they settled now, I would not pursue interest charges. The above charges were applied to my account over the last 6 years, whilst we were impossibly trying to live off one wage. The bank caused my near demise and also vast mental pressure, stopped me wanting to sleep and tape up th eletter box. This morning I have received a letter from the bank advising that although they believe their charges are fair, as a gesture of goodwill, they will pay the full amount of £4,800. I feel so happy.

 

I want to thank this website, martins money saving expert and all you people out there who have helped me with your kind advice aiding me and probably thousands of others, in the stance against a banking attitude that is crippling people normal folk on average incomes.

WON at LBA with compound contractual interest £607

 

RBS BF Account S.A.R - (Subject Access Request) sent 4/11, part response rec'd 28/11, further info sent 3/12 awaiting statements at 20/12, Sent LBA 19/01/07. Received all statements resulting in 3 claims, £1,278, £4,279 and £7,250(!) all with contractual interest.

Great news , i am in the same boat with the RBS in Scotland.

However i have heard nothing so far and am now in the process of submitting a claim.

My claim is for £8000, did you have to go down the court route or did the bank settle before this?

My claim is tool arge for the small claim courts and am at a loss as to what to do?

I am in the same boat - although I haven't started the process yet, I know my claim will be in the region of 6-8 thousand across 3 accounts. The only thing stopping me is the uncertainty about my initial request for the info - do I request all 3 accounts together, and where do I stand on the 750 quid thing when my claim is much larger. I will continue to do the necessary trawling these threads for info, but if someone could advise on these points I would be really grateful:-)

Hi there

 

Request the info for all 3 accounts at the one time. I did this with BOS. My claim totalled almost £5000. I then split it into 2 claims and started one online with MCOL. As long as you have an address in England that you can use as your address for correspondence you can do this and claim up to £5000 in the small claims in England. You will probably find that once they know that you are serious they will settle the other claim as well.

 

First things first though, get the information. SAR them and they have 40 days in which to respond. Then highlight all the charges and use the template spreadsheet to calculate the exact amount of charges on each account. Use a separate spreadsheet for each account but you can claim 2 accounts at once and just enclose both spreadsheets.

 

They may well pay up all at once but send off 3 letters requesting payment, as opposed to just one asking for the whole lot. That way, you can start one court claim while the others are still being dealt with.
