      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

First off let me explain that I'm not THE (by now infamous) Brian Smith!!

I've been a citicard customer for a few years now and I'm about to start proceedings to claim back charges for late payments etc. After reading through a good few of the cases in this forum it looks like they're one of the most difficult to deal with :Cry:

Good luck ! I'm one step ahead having posted my SAR in December. They will write back to you requesting ID - might be worth enclosing that now to save time. They wanted a photocopy of my driving licence and a copy utility bill.

Received a Subject Access Request Form from Citi Cards this morning :rolleyes:

 

I've filled it in and will post it tomorrow, but it just seems like a delaying tactic to me on Citi's part, as the only additional details on the the form that weren't already in my covering letter is my date of birth. They also ask for 2 means of ID, which I already sent in with my original request (driving license and utility bill)

 

I take it the 40 day timetable still runs from my initial request and not when they recieve the form back? Also, do I still need to send in additional ID with the form, or simply state in a covering letter that I have already sent the requested ID with my SAR?

I would send back the form with your DOB added and a big note drawing their attention to the fact that you have already submitted evidence of ID with your SAR.

 

Furthermore, point out to them that the 40 days counts from your original request.

Seconded, the ID forms are just another delaying tactic.

Advice offered by ENRON is without prejudice and is for your judgement as to whether to take it. You should seek the assistance or hire of a solicitor or other paid professional if in doubt.

Received my Statements from Citi today - with just 2 days to spare!

 

Anyway, I've downloaded the spreadsheet and calculated £775.00 in charges without interest (+£160.73 @8% = £935.73) for the last 5 years and will attach to Prelim letter to be posted tomorrow.

 

Not sure whether to drop 1 of the charges (£25.00) so that it falls to the £750 threshold for Small Claims in Scotland, or just go for it through Summary Cause.:|

I've got my Preliminary Approach typed up and ready to post tomorrow morning, but I was wondering if I can dictate which account I would like any repayments made to, eg my BoS account (highly unlikely I know...but), or are they only payable to my account with them, ie my credit card?

Received the usual bog off letter from Mark Clibbens this morning :rolleyes:.....get my LBA ready for posting on Monday now I suppose. I must admit I was quite impressed with how quickly they replied to my Initial Request - 5 days. Must be a record??

No....no offer at all. Just the usual story about the OFT report....; Citi have defended over a dozen cases successfully......; I should contact the FLA for a review......; Contact the FOS etc etc....

Just a thought about sending my LBA. The reply from Citi to my Preliminary Approach was delivered well before the 14 days given to them. Seeing as I've already had a reply within the timescale, should I send the LBA now - or wait for the 14 days which expires on 26th March?

I suppose I should start getting everything ready for lodging my claim at the Court :)

Today (Thursday) I received a stalling letter from Mark Clibbens which is dated 3rd April - exactly the date the 14 days for LBA expired:

 

Thank you for taking the time...blah, blah, blah

I understand that you have contacted us previously about this matter, which we will now look into again for you. To allow me to review your request I may be required to obtain copies of your statements. Unfortunately, if this is the case, it may take between six and eight weeks as they are retrieved from our archives, however if you have previously requested these statements as a Data Subject Access request, I may be able to get this information sooner.

 

Once I have the information and assessed your request I will confirm in writing the outcome.......blah, blah, blah

 

I think I have 2 options here, and personally I prefer the 1st:

 

1 - Ignore this letter, fill out Form 1b, and deliver it to court on Monday anyway.

2 - I'll write a wee letter reminding him about the LBA, but give them another 7 days 'as a good will gesture' to settle in full before going to court.

 

Any thoughts anyone?

Just checked local court and they don't shut for Easter:D, so it's through to Stonehaven on Monday to start my claim.

 

One wee question though: I've heard that Citi's address in Reading should be used on the claim form. I've checked the Citi address thread here, but can't find the Reading address. Can someone let me know what it is please?
